Writ Seizure Sale Dispute Ownership Goods Seized


Seorang Syerif di Mahkamah Sesyen melaksanakan satu Writ Penyitaan dan Penjualan dalam pelaksanaan satu Penghakiman bagi harta Penghutang Penghakiman (judgment debtor).
A Sheriff of the Sessions Court executed a Writ of Seizure and Sale in the enforcement of a Judgment on the goods of a Judgment Debtor.


Pihak penuntut mengeluarkan satu surat ikatan jualan bagi menuntut hak milik sesetengah barangan yang disita. Oleh itu, terdapat satu pertikaian tentang hak milik barangan yang disita, sama ada ia milik Penghutang Penghakiman.
A claimant produced a deed of sale claiming ownership of certain goods seized.   Therefore there was a dispute on the ownership of the goods seized, whether they belonged to the Judgment Debtor.


Mahkamah memutuskan bahawa Surat Ikatan Jualan yang dikeluarkan oleh pihak penuntut adalah pemikiran selepas (after thought) dan menolak tuntutan pihak penuntut untuk hak milik barangan tersebut.
The court held that the Deed of Sale produced by the claimant was an after thought and dismissed the claim of the claimant for the ownership of the seized goods.
