July 14, 2023 Kuala Lumpur High Court
Coram Mr Justice Dato’ Amarjeet Singh A/L Serjit Singh
If it pleases you My Lord,
2 May I crave leave to move the proceedings for Your Petitioner Miss Kelly Ha and my learned friend representing the Kuala Lumpur Bar Committee, Mr Harnesh Singh will now double up to represent both the Selangor Bar Committee and the Bar Council, to which I am indebted.
3 May I introduce the Petitioner, Kelly Ha.
4 Your Petitioner was born and raised in Sarikei, a small town in the state of Sarawak.
5 Your Petitioner is the middle child in the family, her parents, Mr Ha Tiong Fong and Madam Teng Hoon Ping are both present here today.
I crave leave for them to be introduced.
6 Your Petitioner went to Methodist Anglo Chinese Primary School and later St Anthony Secondary School. She chose the science stream in her final two years of secondary school’s education. However, she later discovered that the science course was not her cup of tea and later changed her mind to become a lawyer as inspired by her father.
7 The petitioner’s father is also a an Advocate from Sarawak where he has always taught her the knowledge of law since she was young. Your petitioner later developed an interest in law as she wishes to become a good civil litigator to help those in need.
8 Your Petitioner read laws at the University of Liverpool and graduated in the year 2020 with second-class Honours. She then completed the Certificate in Legal Practice course as well as her Master of Law in the University of Malaya in the year 2022. She proceeded to read in the chambers of her pupil mistress, Miss Lim Soo Zee from Messrs Wayne Ng, Yong & Lim.
9 I am sure that Your Petitioner received the best tutelage and guidance that a pupil could get from any master, as Soo Zee is my pupil…
9.1 So technically Your Petitioner is a grand pupil if there is such a term, then it would make me the Grand master…
in the world of Jacky Chan and Shaolin kung Fu that would have been quite fun
My Lord,
10 On this special occasion, the Petitioner would like to express her gratitude to her parents and her family members for their continuous support and encouragement throughout these years. The Petitioner is blessed to have them who are always by their side and no words can express how thankful she is for their endless sacrifice, love and support to ensure that Petitioner is who she is today.
11 The Petitioner would also like to thank her pupil Mistress, Miss Lim Soo Zee for providing her with all the opportunities and guidance throughout her pupillage.
12 Your Petitioner is also grateful for Miss Lim’s willingness in teaching her the art of advocacy, drafting skills by bringing her to court trials and hearings.
13 I asked her what is the most memorable lessons from Miss Lim, your petitioner, this is what she told me:
“Miss Lim exposed me to various judgments and especially those from Lord Denning, the renowned English judge.
His Lordship was a tremendous inspiration for my career in litigation. His profound intellect, unwavering commitment to justice, and groundbreaking judgments ignited my passion for the legal profession. Lord Denning’s ability to eloquently articulate legal principles, his innovative approach to the law, and his unwavering sense of fairness have left an indelible mark on me.
His Lordship’s famous judgment, such as the seminal ruling in the case of Central London Property Trust Ltd v High Trees House Ltd [1947] KB 130, have shown me the transformative power of the law and the importance of upholding justice. Lord Denning’s legacy continues to inspire and drive me to pursue a career dedicated to seeking truth, advocating for justice, and making a positive impact through the practice of litigation.
Lord Denning in the case Gouriet vs Union of Postal Workers and Others [1977] 3 All ER 70 once said,
“Be you ever so high, the law is above you.” This quote embodies his belief in the supremacy of the law and serves as a constant reminder of the essential role of justice in our society.
14 Your Petitioner would like to thank all his colleagues at Messrs Wayne Ng, Yong & Lim for their patient guidance and assistance throughout her tenure of pupillage.
My Lord,
15 I believe Your Petitioner is a fit and proper person to be part of the profession, all the papers are in order and the relevant bodies have no objections to the cause. Therefore I humbly pray that Your Petitioner be admitted and enrolled as an Advocate and Solicitor of the High Court of Malaya.
16 I am obliged.
[Order]17 I seek leave from this Honourable Court for me to robe the Petitioner as the Petitioner’s pupil Mistress, Miss Lim is unfortunately indisposed as she is conducting a trial today.
18 I am obliged.
