Completing my nine-month pupillage at Alex Chang & Co has been a transformative experience, with trial preparation standing out as a defining moment. Working closely with Mr Alex Chang and the team, I witnessed firsthand the meticulous groundwork required before stepping into the courtroom. My time in chambers deepened my appreciation of the dedication and precision that litigation demands.
The Crucial Stage of Preparation
1 From the very beginning of my pupillage, I was deeply involved in trial preparation. Our firm represented the Plaintiff in a claim under a Private Finance Initiative (PFI) agreement against a prominent government-linked company. Reviewing multiple volumes of the common bundle of documents already filed in court, particularly on a subject as technical as mechanics, was an entirely new experience for me.
Learning to Adapt Under Pressure
2 One of the most challenging moments arose when we discovered about 2 months before trial that there was a crucial oversight by the former solicitors—key documents essential to a significant portion of our claim were missing. With the trial fast approaching, we had to act swiftly to gather and compile the necessary materials.
2.1 Our task involved combing through thousands of pages of documents, receipts, invoices, agreements, and correspondences to substantiate a RM2.8 million project cost claim.
3 Despite immense pressure, we successfully compiled over 900 pages of new material and submitted them within the deadline. This experience reinforced a vital lesson: while preparation is the cornerstone of legal advocacy, adaptability is equally crucial. Legal proceedings are often unpredictable, and the ability to respond swiftly under pressure is an invaluable skill.
4 My primary role involved organising the Common Bundle of Documents, an initially daunting task. These bundles, containing all the evidence supporting our client’s claim, formed the backbone of the case. Ensuring accuracy, clarity, and coherence was essential for a seamless trial process.
The Intensity of the Pre-Trial Stage
5 Despite being rewarding, preparing for trial was incredibly demanding. With tight deadlines, I quickly realised that no matter how much time was allocated, there was always more to be done. Our team juggled multiple responsibilities—compiling documents, reviewing evidence, drafting statements—all while feeling the mounting pressure as the trial date approached.
6 This fast-paced environment taught me a crucial truth: time is never enough. Despite meticulous efforts, last-minute challenges, additional documents, and unexpected complications always arose. However, these moments also highlighted the significance of teamwork. Legal practice is not merely about individual excellence but about collaboration—working seamlessly with colleagues, clients, opposing counsel, and the court.
Preparing the Witness Statements
7 Beyond handling documents, liaising with the client and assisting in drafting witness statements provided me with a deeper appreciation of case intricacies. It was not just about gathering facts but about weaving a compelling narrative that effectively represented the client’s position.
8 Attending extensive meetings with the witnesses and counsel, I came to understand that every conversation and detail mattered—preparation was not merely a phase of the trial but the foundation upon which the entire case rested.
A Rewarding Experience: The True Essence of Advocacy
9 Reflecting on my pupillage, trial preparation stands out as one of the most pivotal experiences. I realised that success in legal practice is not defined by dramatic courtroom moments but by the relentless hours spent ensuring that every detail is in place. While I initially sought the thrill of courtroom advocacy, I came to appreciate that the real victory lies in the preparation—strengthening our client’s position before the trial even begins.
