
Foreword to First Edition
For many years now, local practitioners have had to be content with the magnificent works of Mr Justice McPherson and other eminent English and Australian authors for a crystallization of the laws relating to liquidation. When it comes to court forms relating to winding-up, Atkin’s is usually resorted to. Reference to these foreign publications necessitate a familiarity with the foreign rules and legislation applicable at the respective press times, otherwise wrong principles may be applied as the Companies Act, both in England and Australia (now the Corporation Act), have undergone changes not seen in our Companies Act 1965.
When I was informed by Malayan Law Journal Sdn Bhd that a handbook of this nature would soon be published to ‘localize’ the laws relating to liquidation, I was delighted that our local practitioners would have the opportunity of an invaluable access to an important reference source. The publication has now become a reality and I am pleased to learn that Alex Chang Huey Wah is the advisory editor. Alex Chang has been an advocate and solicitor for many years and has considerable experience in commercial and other litigation. I understand he is one of the course directors for the Malaysian Institute of Accountants in their Continuing, Professional Development courses. Alex Chang’s exposure to commercial and company law litigation can be found in various law reports published in Malaysia.
This three-division handbook deals comprehensively with the law and practice relating to petitions for compulsory winding-up by the court under s 218 of the Companies Act 1965. It also covers post winding-up proceedings. It is concisely set out, section by section and annotated. All the relevant forms are also included to provide an easy reference which is most certainly a commendable publication which can be put to excellent use by practicing members of the Bar and others whose duties involve considerable contact with commercial and company law.
