class=\"wp-block-separator\"\/>\n\n\n\n<p>\u63a5\u79cd\u75ab\u82d7\u6210\u4e3a\u83b7\u53d6\u5de5\u4f5c\u7684\u5fc5\u8981\u6761\u4ef6\uff1f<\/p>\n\n\n\n<p>\u65b0\u51a0\u75ab\u60c5\u81ea2020\u5e741\u6708\u7206\u53d1\u81f3\u4eca\u5df2\u7ecf\u8d85\u8fc7\u4e00\u5e74\u4e4b\u4e45\uff0c\u5168\u4e16\u754c\u6ca1\u6709\u56fd\u5bb6\u80fd\u5e78\u514d\u4e8e\u6b64\uff0c\u5373\u4fbf\u8fde\u53f0\u6e7e\u8fd9\u4e2a\u5728\u9632\u75ab\u4e0a\u8fd1\u4e4e\u6ef4\u6c34\u4e0d\u6f0f\u7684\u5730\u533a\u4e5f\u5728\u4eca\u5e745\u6708\u65f6\u6ca6\u9677\u3002\u8fd9\u53ef\u76f4\u63a5\u8bc1\u660e\u4e86\u8fd9\u75c5\u6bd2\u662f\u65e0\u5b54\u4e0d\u5165\u7684\u3002\u4e5f\u6b63\u56e0\u6b64\uff0c\u5168\u7403\u6240\u6709\u56fd\u5bb6\u90fd\u5728\u79ef\u6781\u5c55\u5f00\u75ab\u82d7\u7684\u65bd\u6253\uff0c\u4ee5\u5c3d\u5feb\u7ed3\u675f\u6b64\u6b21\u5168\u7403\u6027\u7684\u761f\u75ab\u3002<\/p>\n\n\n\n<p>\u4e5f\u56e0\u4e3a\u5168\u7403\u8bb8\u591a\u56fd\u5bb6\u5df2\u7ecf\u6210\u529f\u7814\u53d1\u51fa\u75ab\u82d7\uff0c\u4e50\u89c2\u4e0a\u8bf4\uff0c\u4eba\u7c7b\u5bf9\u4e8e\u6218\u80dc\u75ab\u60c5\u53ea\u662f\u65f6\u95f4\u4e0a\u7684\u95ee\u9898\u3002\u56e0\u6b64\uff0c\u8bb8\u591a\u4eba\u5df2\u7ecf\u5728\u8003\u8651\u75ab\u60c5\u4e4b\u540e\u7684\u4e8b\u5b9c\uff0c\u5176\u4e2d\u4e00\u4e9b\u96c7\u4e3b\u63d0\u51fa\u662f\u5426\u53ef\u4ee5<strong><em>\u8981\u6c42\u5e94\u8058\u8005\u63a5\u79cd\u65b0\u51a0\u75ab\u82d7\uff0c\u6216\u8005\u5f3a\u5236\u8981\u6c42\u73b0\u6709\u5458\u5de5\u63a5\u79cd\u65b0\u51a0\u75ab\u82d7\uff0c\u62d2\u7edd\u8005\u5c06\u4e0d\u88ab\u5f55\u7528\u6216\u8f9e\u9000<\/em><\/strong>\u7684\u95ee\u9898\u3002\u5bf9\u6b64\uff0c\u6211\u4eec\u5c06\u4ece\u6cd5\u5f8b\u7684\u89d2\u5ea6\u53bb\u63a2\u8ba8\u8fd9\u4e00\u9879\u8bfe\u9898\u3002<\/p>\n\n\n\n<p>\u9996\u5148\uff0c\u9a6c\u6765\u897f\u4e9a\u5e76<strong><em>\u6ca1\u6709<\/em><\/strong>\u4efb\u4f55\u4e00\u9879\u6cd5\u5f8b\u5199\u660e\u4eba\u6c11\u6709\u4e49\u52a1\u63a5\u79cd\u75ab\u82d7(compulsory vaccination)\uff0c\u4e5f\u6b63\u662f\u5982\u6b64\uff0c\u4eba\u6c11\u624d\u5fc5\u987b\u81ea\u884c\u4e0a\u7f51\u6ce8\u518c\u767b\u8bb0\u65b9\u80fd\u63a5\u79cd\u75ab\u82d7\u3002\u5f53\u7136\uff0c\u8fd9\u5e76\u4e0d\u5b8c\u5168\u610f\u5473\u7740\u96c7\u4e3b\u5c31\u4e0d\u80fd\u8981\u6c42\u5e94\u8058\u5458\u6216\u5458\u5de5\u63a5\u79cd\u75ab\u82d7\u3002<\/p>\n\n\n\n<p>\u96c7\u4f63\u5408\u7ea6<\/p>\n\n\n\n<p>\u9a6c\u6765\u897f\u4e9a\u534a\u5c9b\u7684\u96c7\u4f63\u5408\u7ea6(Employment Contract) \u662f\u53d7\u5236\u4e8eEmployment Act 1955<a href=\"#_ftn1\">[1]<\/a> \u53ca\u5176\u4ed6\u6cd5\u6848<a href=\"#_ftn2\">[2]<\/a>\u3002\u800c\u5f88\u9057\u61be\u7684\u662f\uff0c\u76ee\u524d\u6ca1\u6709\u4efb\u4f55\u6cd5\u89c4\uff0c\u5305\u62ec\u5728\u7d27\u6025\u72b6\u6001\u4e0b\u7684\u6cd5\u5f8b\uff0c\u89c4\u5b9a\u96c7\u5458\u5fc5\u987b\u63a5\u79cd\u65b0\u51a0\u75ab\u82d7\uff0c\u6216\u8005\u8981\u6c42\u96c7\u4e3b\u5fc5\u987b\u786e\u4fdd\u96c7\u5458\u63a5\u79cd\u65b0\u51a0\u75ab\u82d7\u3002<\/p>\n\n\n\n<p>\u56e0\u6b64\uff0c\u5173\u4e8e\u63a5\u79cd\u75ab\u82d7\u7684\u5408\u7ea6\u6761\u6b3e\u4f9d\u7136\u662f\u53d7\u5236\u4e8e\u57fa\u672c\u7684\u5408\u7ea6\u6cd5\u3002<\/p>\n\n\n\n<p>\u5728\u9a6c\u6765\u897f\u4e9a\uff0c\u4e00\u9879\u88ab\u6cd5\u5f8b\u6240\u627f\u8ba4\u7684\u5408\u7ea6\u5e94\u8be5\u5177\u5907\u4e864\u8981\u7d20\uff0c\u5373\u732e\u8bae\uff08\u4ee5\u4e0b\u79f0\u4e3aoffer\uff09, \u63a5\u53d7(\u4ee5\u4e0b\u79f0\u4e3aacceptance), \u8d23\u4efb(consideration) \u4e0e \u5efa\u7acb\u6cd5\u5f8b\u5173\u7cfb\u7684\u610f\u56fe(intention to create legal relation)\u3002\u5bf9\u4e8e\u96c7\u4e3b\u662f\u5426\u53ef\u4ee5\u8981\u6c42\u5458\u5de5\u63a5\u79cd\u65b0\u51a0\u75ab\u82d7\uff0c\u5219\u6db5\u76d6\u5728offer\u4e0eacceptance\u7684\u8303\u56f4\u4e2d\u3002<\/p>\n\n\n\n<p>Offer\uff0c\u7b80\u5355\u7406\u89e3\u4fbf\u662f\u63d0\u51fa\u6761\u4ef6\u3002\u4efb\u4f55\u4e00\u4e2a\u4eba\u90fd\u53ef\u4ee5\u5411\u53e6\u4e00\u4e2a\u4eba\u63d0\u51fa\u4efb\u4f55<strong><em>\u5408\u6cd5<\/em><\/strong>\u7684\u6761\u4ef6\u3002\u800c\u5bf9\u4e8e\u63a5\u79cd\u75ab\u82d7\uff0c\u867d\u7136\u9a6c\u6765\u897f\u4e9a\u6cd5\u5f8b\u5e76\u6ca1\u6709\u9650\u5236\u6216\u8981\u6c42\u96c7\u4e3b\u5c06\u63a5\u79cd\u75ab\u82d7\u8bbe\u7acb\u4e3a\u5f55\u53d6\u7684\u6761\u4ef6\u4e4b\u4e00\uff0c\u4f46\u6839\u636eOccupational Safety and Health Act 1994\u7b2c15\u6761\u6587<a href=\"#_ftn3\">[3]<\/a>\uff0c\u96c7\u4e3b\u6709\u8d23\u4efb\u786e\u4fdd\u96c7\u5458\u7684\u5b89\u5168\u4e0e\u5065\u5eb7\u3002\u8fd9\u4e00\u6761\u4f8b\u5341\u5206\u5730\u5e7f\u6cdb\uff0c\u53ef\u4ee5\u5c06\u5176\u89e3\u8bfb\u6210\u96c7\u4e3b<strong><em>\u6709\u8d23\u4efb\u51cf\u4f4e\u5458\u5de5\u5728\u5de5\u4f5c\u65f6\u95f4\u611f\u67d3<u>\u65b0\u51a0\u75c5\u6bd2\u7684\u98ce\u9669<\/u><\/em><\/strong>\u3002\u800c\u57fa\u4e8e\u63a5\u79cd\u75ab\u82d7\u53ef\u4ee5\u51cf\u4f4e\u5458\u5de5\u5728\u5de5\u4f5c\u73af\u5883\u4e2d\u611f\u67d3\u65b0\u51a0\u75c5\u6bd2\u7684\u98ce\u9669\uff0c\u56e0\u6b64\u5c06\u63a5\u79cd\u75ab\u82d7\u4f5c\u4e3a\u5e94\u8058\u7684\u6761\u4ef6\u4e4b\u4e00\u662f\u5b8c\u5168\u5408\u6cd5\u7684\u3002<\/p>\n\n\n\n<p>\u5173\u4e8e\u8fd9\u70b9\u53ef\u4ee5\u53c2\u8003\u9a6c\u6765\u897f\u4e9a\u96c7\u4e3b\u8054\u5408\u4f1a\u4e3b\u5e2d Datuk Dr Syed Hussain Syed Husman \u5728\u63a5\u53d7<em>The Star <\/em>\u91c7\u8bbf\u6240\u8868\u793a\u7684\uff0c\u516c\u53f8\u5b8c\u5168\u6709\u6743\u529b\u5c06\u63a5\u79cd\u75ab\u82d7\u56ca\u62ec\u5165\u96c7\u4f63\u6761\u6b3e\u4e4b\u4e2d\u3002<\/p>\n\n\n\n<p>\u6b64\u5916\uff0c\u8d44\u6df1\u52b3\u5de5\u6cd5\u5f8b\u5e08\uff0c Datuk Thavalingam Thavarajah \u540c\u6837\u8868\u793a\u5373\u4fbf\u96c7\u4e3b\u6ca1\u6709\u6cd5\u5f8b\u4e49\u52a1\u8981\u6c42\u96c7\u5458\u63a5\u79cd\u75ab\u82d7\uff0c\u96c7\u4e3b\u4f9d\u7136\u53ef\u4ee5\u5c06\u63a5\u79cd\u75ab\u82d7\u4f5c\u4e3a\u96c7\u4f63\u7684\u5148\u51b3\u6761\u4ef6\u3002<\/p>\n\n\n\n<p>\u800c\u57fa\u4e8eacceptance\u5fc5\u987b\u662f\u5b8c\u6574\u5730\u63a5\u7eb3offer\u4e2d<strong><em>\u6240\u6709\u6761\u6b3e<\/em><\/strong>\uff0c\u5018\u82e5\u5e94\u8058\u5458\u57fa\u4e8e\u4efb\u4f55\u7406\u7531\u62d2\u7edd\u63a5\u79cd\u75ab\u82d7\uff0c\u90a3\u4e48\u96c7\u5458\u5b8c\u5168\u53ef\u4ee5\u62d2\u7edd\u5f55\u53d6\u8be5\u5e94\u8058\u5458\u3002\u53cd\u4e4b\uff0c\u5018\u82e5\u96c7\u4e3b\u5728\u8be5<strong><em>\u5e94\u8058\u5458\u660e\u786e\u8868\u793a\u62d2\u7edd\u63a5\u79cd\u75ab\u82d7\u540e\u4f9d\u7136\u5f55\u53d6\u4e86\u4ed6<\/em><\/strong>\uff0c\u90a3\u4e48\u6cd5\u5f8b\u5c06\u89c6\u96c7\u4e3b<strong><em>\u63a5\u53d7<\/em><\/strong>\u5e94\u8058\u5458\u4e0d\u63a5\u79cd\u75ab\u82d7\u7684\u51b3\u5b9a\uff0c\u5e76\u4e14<strong><em>\u4e0d\u53ef\u5f3a\u5236\u8be5\u5458\u5de5\u65bd\u6253\u75ab\u82d7<\/em><\/strong>\u3002<\/p>\n\n\n\n<p>\u540c\u7406\uff0c\u5bf9\u4e8e\u73b0\u6709\u7684\u5458\u5de5\uff0c\u5018\u82e5<strong><em>\u96c7\u4f63\u5408\u7ea6\u6ca1\u6709\u96c7\u4e3b\u53ef\u4ee5\u8981\u6c42\u5458\u5de5\u65bd\u6253\u75ab\u82d7\u7684\u6761\u6b3e<\/em><\/strong>\uff0c\u90a3\u4e48\u96c7\u4e3b\u5c06<strong><em>\u65e0\u6cd5\u5f3a\u5236<\/em><\/strong>\u8981\u6c42\u5458\u5de5\u63a5\u79cd\u75ab\u82d7\u3002\u800c\u5018\u82e5\u96c7\u4e3b\u56e0\u6b64\u8f9e\u9000\u62d2\u7edd\u63a5\u79cd\u75ab\u82d7\u7684\u5458\u5de5\uff0c\u96c7\u4e3b\u6216\u56e0\u8fdd\u53cd\u96c7\u4f63\u5408\u7ea6\u800c\u9762\u5bf9\u6c11\u4e8b\u8bc9\u8bbc\u3002<\/p>\n\n\n\n<p>\u7ed3\u8bed<\/p>\n\n\n\n<p>\u5728\u9762\u5bf9\u6b64\u6b21\u5168\u7403\u5927\u707e\u96be\uff0c\u96c7\u4e3b\u8981\u6c42\u5458\u5de5\u63a5\u79cd\u75ab\u82d7\u53ef\u4ee5\u8bf4\u662f\u5341\u5206\u5408\u7406\u7684\uff0c\u4f46\u57fa\u4e8e\u6cd5\u5f8b\u4e0a\u5e76\u6ca1\u6709\u9610\u660e\u6b64\u4e49\u52a1\uff0c\u5f3a\u5236\u8981\u6c42\u73b0\u6709\u5458\u5de5\u63a5\u79cd\u75ab\u82d7\u53cd\u800c\u53ef\u80fd\u4f1a\u8fdd\u53cd\u96c7\u4f63\u5408\u7ea6\u3002\u56e0\u6b64\u96c7\u4e3b\u5728\u8981\u6c42\u5458\u5de5\u63a5\u79cd\u75ab\u82d7\u4e4b\u65f6\u5fc5\u987b\u4ece\u65b0\u5ba1\u89c6\u96c7\u4f63\u5408\u7ea6\u3002<\/p>\n\n\n\n<p>\u5f53\u7136\uff0c\u5018\u82e5\u96c7\u4e3b\u8981\u6c42\u5458\u5de5\u63a5\u79cd\u75ab\u82d7\uff0c\u5168\u56fd\u75ab\u82d7\u7684\u65bd\u6253\u5b9a\u7136\u53ef\u4ee5\u52a0\u5feb\uff0c\u8fd9\u4e0d\u4ec5\u53ef\u4ee5\u4fdd\u62a4\u540c\u5904\u4e00\u4e2a\u5de5\u4f5c\u73af\u5883\u4e0b\u7684\u540c\u4e8b\uff0c\u66f4\u53ef\u4ee5\u52a0\u5feb\u5168\u56fd\u7684\u7fa4\u4f53\u514d\u75ab\u8fdb\u7a0b\uff0c\u4ece\u800c\u7ed3\u675f\u6b64\u6b21\u5168\u7403\u6027\u5927\u707e\u96be\u3002<\/p>\n\n\n\n<p>\u63a5\u79cd\u75ab\u82d7\uff0c\u4e0d\u4ec5\u662f\u4fdd\u62a4\u81ea\u5df1\uff0c\u66f4\u662f\u4fdd\u62a4\u8eab\u8fb9\u6240\u6709\u4eba\u3002<\/p>\n\n\n\n<p>Soo
