The Prime Minister was teasing the crowd, saying it was not easy to declare a public holiday.\u00a0 Many Malaysians Employers are surely wondering how the Government can declare a public holiday in Malaysia?<br><br><em>Kerajaan Malaysia mengisytiharkan 4 September 2017 sebagai cuti umum mengikuti pencapaian cemerlang Malaysia dalam Sukan SEA ke-29. Perdana Menteri mengusik orang ramai, dengan mengatakan bahawa bukannya mudah untuk mengisytiharkan cuti umum. Ramai Majikan di Malaysia pasti tertanya-tanya bagaimana Kerajaan boleh mengisytiharkan cuti umum di Malaysia?<\/em><\/p>\n\n\n\n<p><em>We will explain how \u00a0the Employers need only to observe 11 days per year of the Gazetted holidays, out of which the employers are free to choose 6 out of the 11 days.\u00a0<\/em><br><br><em>Kami akan menerangkan bagaimana pihak Majikan hanya perlu mematuhi 11 hari setahun dari cuti yang diwartakan, di mana majikan adalah bebas untuk memilih 6 dari 11 hari.<\/em><\/p>\n\n\n\n<p><strong>How many Public Holidays do We have?<\/strong><br><strong><em>Berapa Cuti Umum yang kita ada?<\/em><\/strong><\/p>\n\n\n\n<p>Public Holiday are listed\u00a0 in the First Schedule of the Holidays Act. Cuti kebangsaan merupakan cuti umum yang dinyatakan di atas, biasanya dipatuhi oleh kebanyakan organisasi kerajaan dan swasta. Cuti negeri biasanya dipatuhi oleh negeri tertentu di Malaysia atau apabila ia berkaitan dengan negeri tersebut sendiri menurut seksyen 9 (1) Akta Hari Kelepasan.<\/em><\/p>\n\n\n\n<p>As an example let us take Kuala Lumpur, the national capital of the country. Kuala Lumpur celebrates New Year\u2019s Day on January 1, Thaipusam, Nuzul Al-Quran and Awal Muharram.<br><br><em>Sebagai contoh kita mengambil Kuala Lumpur, ibu negara Malaysia. Kuala Lumpur meraikan Hari Tahun Baru pada 1 Januari, Thaipusam, Nuzul Al-Quran dan Awal Muharram.<\/em><\/p>\n\n\n\n<p>Kuala Lumpur also celebrates a special holiday called Federal Territory Day along with only two other territories on February 1 according to section 9(2) of the Holidays Act. \u00a0Federal Territory Day in Kuala Lumpur celebrates the formation of the territory in 1974. \u00a0Prior to that, Kuala Lumpur and the area now known as Putrajaya were under the state of Selangor.<br><br><em>Kuala Lumpur juga meraikan satu percutian khas yang dipanggil Hari Wilayah Persekutuan bersama dengan dua wilayah lain pada 1 Februari menurut seksyen 9 (2) Akta Hari Kelepasan. Hari Wilayah Persekutuan di Kuala Lumpur meraikan penubuhan wilayah tersebut pada tahun 1974. Sebelum itu, Kuala Lumpur dan kawasan yang kini dikenali sebagai Putrajaya berada di bawah negeri Selangor.<\/em><\/p>\n\n\n\n<p><strong>The Private Sector: 11 Days to be Observed. \u00a0 \u00a0<\/strong><br><strong>5 Compulsory Days \u00a0and 6 Elective Days<\/strong><\/p>\n\n\n\n<p><strong><em>Sektor Swasta: 11 Hari yang Perlu Dipatuhi.<\/em><\/strong><br><strong><em>5 Hari Wajib dan 6 Hari Pilihan<\/em><\/strong><\/p>\n\n\n\n<p>Fortunately, for the Employers, Section 60D of the Employment Act only provides every employees to be entitled to the 11 gazetted public holidays and any day appointed as a public holiday under section 8 of the Holidays Act (for example, September 4, 2017).<br><br><em>Mujurnya bagi Pihak Majikan, Seksyen 60D Akta Hari Kelepasan hanya memperuntukkan setiap pekerja berhak mendapatkan 11 cuti umum yang diwartakan dan mana-mana hari yang diumum sebagai cuti umum di bawah seksyen 8 Akta Hari Kelepasan (contohnya, 4 September 2017).<\/em><\/p>\n\n\n\n<p>That is to say employers are not\u00a0 required to observe these state level holidays.\u00a0 As such, the employees are still required to work as usual if the employers do not declare these state level holidays as paid holidays.<br><br><em>Maksudnya pihak majikan tidak diminta untuk memerhati cuti-cuti peringkat negeri ini. Oleh yang demikian, pekerja-pekerja masih perlu bekerja seperti biasa sekiranya pihak majikan tidak mengisytiharkan cuti-cuti peringkat negeri ini sebagai cuti bergaji.<\/em><\/p>\n\n\n\n<p>Exceptions are, Federal Territory Day must be observed in the Federal Territory of Kuala Lumpur, Putrajaya and Labuan. In other states, the Birthday of the Ruler or the Yang di-Pertua Negeri must be observed.<br><br><em>Pengecualian adalah, Hari Wilayah Persekutuan mesti dipatuhi di Wilayah Persekutuan Kuala Lumpur, Putrajaya dan Labuan. Di negeri lain, Hari Keputeraan Raja atau Yang di-Pertua Negeri mesti dipatuhi.<\/em><\/p>\n\n\n\n<p>Section 60D provides that the employer must list\u00a0 11 gazetted public holidays that the employees are entitled to before the commencement of each calendar year, 5 of which shall be:<br><br>National Day, the Birthday of Yang-Di Pertuan Agong, Birthday of the Ruler or the Yang di-Pertua Negeri or Federal Territory Day, the Worker\u2019s Day and Malaysia Day.<\/p>\n\n\n\n<p><em>Seksyen 60D memperuntukkan bahawa pihak majikan mesti menyenaraikan 11 cuti umum yang diwartakan di mana pekerja berhak kepada sebelum bermulanya setiap tahun kalendar, 5 di antaranya adalah:<\/em><br><br><em>Hari Kebangsaan, Hari Keputeraan Yang-Di Pertuan Agong, Hari Keputeraan Raja atau Yang di-Pertua Negeri atau Hari Wilayah Persekutuan, Hari Pekerja dan Hari Malaysia.<\/em><\/p>\n\n\n\n<p>The Employers are free to choose the remaining 6 holidays to make up the 11 days.<br><br><em>Pihak Majikan mempunyai kebebasan untuk memilih 6 cuti yang tinggal untuk membentuk 11 hari.<\/em><\/p>\n\n\n\n<p>This section allows the\u00a0 employers \u00a0to ask the employees to come to work on Chinese New Year, Hari Raya Aidifiltri or Deepavali!\u00a0\u00a0 As stated earlier, the employer need to list\u00a0 which 11 gazetted public holiday, if your day is not in the list, you have to \u00a0be absent from the table of family gathering.<br><br><em>Seksyen ini membolehkan pihak majikan meminta pekerja-pekerja untuk datang bekerja pada Tahun Baru Cina, Hari Raya Aidifiltri atau Deepavali! Seperti yang dinyatakan sebelum ini, majikan perlu menyenaraikan 11 cuti umum yang diwartakan, jika hari sambutan anda tidak termasuk dalam senarai, anda mesti tidak dapat menyertai perhimpunan keluarga.<\/em><\/p>\n\n\n\n<p><strong>The Minister can create more holidays!<\/strong><br><strong><em>Menteri boleh menetapkan banyak lagi cuti!<\/em><\/strong><\/p>\n\n\n\n<p>The Minister can declare any day as a public holiday according to section 8 of the Holidays Act. \u00a0This section basically gives the Minister responsible the power to appoint any day he wants as a public holiday in the Peninsular, the Federal Territories or certain States (after consulting the States).<br><br><em>Menteri boleh mengisytiharkan mana-mana hari sebagai cuti umum menurut seksyen 8 Akta Hari Kelepasan. Seksyen ini pada dasarnya membenarkan Menteri yang bertanggungjawab untuk menetapkan mana-mana hari yang dia ingini sebagai cuti umum di Semenanjung, Wilayah Persekutuan atau Negeri-negeri tertentu (setelah berbincang dengan Negeri-Negeri tersebut).<\/em><\/p>\n\n\n\n<p>Based on the abovementioned section, Prime Minister is the Minister charged with responsibility for public holiday. \u00a0He may appoint any date, in our scenario, September 4 as a public holiday.\u00a0 This can be seen in a statement issued by the Malaysian Prime Minister\u2019s Department has announced that September 4 as a public holiday in appreciation of the outstanding achievement of the Malaysian contingent in 29th Kuala Lumpur SEA Games.<br><br><em>Berdasarkan seksyen yang disebutkan di atas, Perdana Menteri adalah Menteri yang bertanggungjawab dengan cuti umum. Dia boleh menetapkan mana-mana tarikh, dalam senario kita, 4 haribulan September sebagai cuti umum. Ini dapat dilihat dalam satu kenyataan yang dikeluarkan oleh Jabatan Perdana Menteri Malaysia yang telah mengumumkan 4 September sebagai cuti umum sebagai penghargaan pencapaian cemerlang kontinjen Malaysia dalam Sukan SEA Kuala Lumpur ke-29.<\/em><\/p>\n\n\n\n<p>This holiday is a national holiday and observed throughout Malaysia by the public sector and \u00a0the private sector.\u00a0 Private sector is governed by Employment Act 1955.<br><br><em>Cuti ini adalah cuti kebangsaan dan dipatuhi di seluruh Malaysia oleh sektor awam dan sektor swasta. Sektor swasta adalah dikawal di bawah Akta Kerja 1955.<\/em><\/p>\n\n\n\n<p>It is important to note that the Employment Act only applies to Peninsular Malaysia or West Malaysia. \u00a0Sabah and Sarawak, collectively called East Malaysia, have maintained separate labour enactments.<br><br><em>Ia adalah penting untuk diperhatikan bahawa Akta Kerja hanya dipakai di Semenanjung Malaysia atau Malaysia Barat. Sabah dan Sarawak, yang secara kolektif dipanggil Malaysia Timur, telah mengekalkan enakmen buruh yang berasingan.<\/em><\/p>\n\n\n\n<p><strong>Can the employer asks the employees to work on a Declared Public Holiday?<\/strong><br><strong><em>Bolehkah pihak majikan meminta pekerja-pekerja untuk bekerja pada Cuti Umum yang Diisytiharkan?<\/em><\/strong><\/p>\n\n\n\n<p>Under Section 60 of Employment Act, an employee may be required to work on any paid holiday subjected to two days\u2019 wages at the ordinary rate of pay.<br><em>Di bawah Seksyen 60 Akta Kerja, seorang pekerja boleh diminta untuk bekerja pada mana-mana cuti bergaji tertakluk kepada upah dua hari pada kadar gaji biasa.<\/em><\/p>\n\n\n\n<p>In addition, section 60D 3(b) provides that an employee who works on a holiday shall be entitled to a travelling allowance for that day if payable to him under the terms of his agreement with his employer but such employee shall not be entitled under this subsection to receive an increased rate of any housing allowance or food allowance.<br><br><em>Di samping itu, seksyen 60D 3 (b) memperuntukkan bahawa pekerja yang bekerja pada hari cuti berhak untuk mendapatkan elaun perjalanan bagi hari tersebut jikanya perlu dibayar kepadanya berdasarkan syarat-syarat perjanjian dengan majikannya tetapi pekerja tersebut tidak berhak di bawah subseksyen ini untuk menerima peningkatan kadar elaun perumahan atau elaun makanan.<\/em><\/p>\n\n\n\n<p>Employer may be fined if does not grant leave.<br>\nIn the previous installation of Sultan Muhammad V from Kelantan as Malaysia\u2019s\n15th Yang di-Pertuan Agong, Malaysian Employers Federation (MEF) executive\ndirector Datuk Shamsuddin Bardan has said that employers who do not grant leave\non 24 April could face a &nbsp; fine as according to section 99A of the\nEmployment Act. Meanwhile, Malaysian Trades Union Congress (MTUC) president\nAbdul Halim Bin Mansor said that government and private offices in every state\nshould comply to the holiday as a sign of respect.<\/p>\n\n\n\n<p><em>Majikan boleh didenda sekiranya tidak memberikan cuti.<\/em><br><em>Dalam pertabalan sebelumnya bagi Sultan Muhammad V dari Kelantan sebagai Yang di-Pertuan Agong ke-15 Malaysia, Pengarah Eksekutif Persekutuan Majikan-majikan Malaysia (MEF) Datuk Shamsuddin Bardan telah mengatakan bahawa pihak majikan yang tidak memberikan cuti pada 24 April boleh didenda mengikut seksyen 99A Akta Kerja. Sementara itu, Presiden Kongres Kesatuan Sekerja Malaysia (MTUC) Abdul Halim Bin Mansor mengatakan bahawa pejabat-pejabat kerajaan dan swasta di setiap negeri harus mematuhi cuti tersebut sebagai tanda penghormatan.<\/em><\/p>\n\n\n\n<p><strong>Replacement Day<\/strong><br><strong><em>Hari Cuti Ganti<\/em><\/strong><\/p>\n\n\n\n<p>Some companies may have plans on &nbsp;September 4. &nbsp; The\nemployer may grant the employee any other day as a paid public holiday in\nsubstitution for any of the public holidays according to Section 60D (1A) of\nthe Employment Act.<\/p>\n\n\n\n<p><em>Sebilangan syarikat\nmungkin mempunyai rancangan pada 4 September. Pihak Majikan boleh memberikan\npekerja tersebut mana-mana hari lain sebagai cuti umum bergaji untuk\nmenggantikan cuti umum tersebut mengikut Seksyen 60D (1A) Akta Kerja.<\/em><\/p>\n\n\n\n<p><strong>Conclusion<\/strong><br><strong><em>Kesimpulannya<\/em><\/strong><\/p>\n\n\n\n<p>There are only 11 days of paid Public Holidays, out of which the employers may choose 6 out of 11, \u00a0there are some special holidays the Minister may declare from time to time as special holidays.<br><br><em>Hanya terdapat 11 hari Cuti Umum bergaji, di mana pihak majikan boleh memilih 6 dari 11, terdapat beberapa cuti khas yang boleh diisytiharkan oleh Menteri dari semasa ke semasa sebagai cuti khas.<\/em><\/p>\n\n\n\n<p>However, the employers may nominate a replacement day for these holidays declared at short notice.<br><em>Walau bagaimanapun, pihak majikan boleh menetapkan hari ganti untuk cuti-cuti ini yang diumum dalam masa yang singkat.<\/em><\/p>\n\n\n\n<p>If the employers should require the employees to work during those holidays declared by the minister, the rate of pay is that of a public holiday.<br><em>Sekiranya pihak majikan memerlukan pekerja untuk bekerja pada hari cuti yang diisytiharkan oleh menteri, kadar gaji pekerja adalah seperti kadar pada cuti umum.<\/em><\/p>\n\n\n\n<p>Postscript<br><em>Kata-kata Tambahan<\/em><\/p>\n\n\n\n<p>The relevant principal statutes relating to legislated matters pertaining to public holiday in Malaysia are as follows:<br><em>Undang-undang utama relevan yang berkaitan dengan perkara-perkara yang berkaitan dengan cuti umum di Malaysia adalah seperti berikut:<\/em><\/p>\n\n\n\n<p>Section 3 of Interpretation Act 1948 And 1967 states:<br>\n\u201cpublic holiday\u201d means a public holiday established by law in Malaysia or any\npart of Malaysia.<br>\n\u201cMinister\u201d means, subject to subsection 8(2), a Minister of the Government of\nMalaysia (including the Prime Minister and a Deputy Minister);<\/p>\n\n\n\n<p><em>Seksyen 3 Akta Tafsiran 1948 Dan 1967 menyatakan:<\/em><br><em>&#8220;Cuti umum&#8221; bermaksud cuti umum yang ditetapkan oleh undang-undang di Malaysia atau mana-mana bahagian di Malaysia.<\/em><br><em>&#8220;Menteri&#8221; bermaksud, tertakluk kepada subseksyen 8 (2), seorang Menteri dari Kerajaan Malaysia (termasuk Perdana Menteri dan seorang Timbalan Menteri);<\/em><\/p>\n\n\n\n<p>Also, Section 8(2) of Interpretation Acts 1948 And 1967 states:<br>\nReferences to \u201cthe High Court\u201d, \u201cthe Minister\u201d and \u201cthe Treasury\u201d<br>\n(2) A reference to \u201cthe Minister\u201d is a reference to the Minister for the time being\nresponsible for the matter in connection with which the reference is made.<\/p>\n\n\n\n<p><em>Selain itu, Seksyen 8 (2) Akta Tafsiran 1948 dan 1967 menyatakan:<\/em><br><em>Rujukan kepada &#8220;Mahkamah Tinggi&#8221;, &#8220;Menteri&#8221; dan &#8220;Perbendaharaan&#8221;<\/em><br><em>(2) Rujukan kepada &#8220;Menteri&#8221; adalah rujukan kepada Menteri buat masa ini bertanggungjawab atas perkara yang berhubungan dengan yang mana rujukan tersebut dibuat.<\/em><\/p>\n\n\n\n<p>In turn, Section 2 of the Holidays Act 1951 states:<br>\n\u201cMinister\u201d means the Minister charged with the responsibility for public and\nbank holidays.And, Section 8 of the Holidays Act 1951 provides that:<br>\nMinister may appoint special days to be observed as bank or public holidays<br>\nThe Minister may, by notification in the Gazette or in such other manner as he\nthinks fit, appoint, in respect of Peninsular Malaysia, or the Federal\nTerritory or, after consultation with the State Authority, in respect of a\nState, a day to be observed as a public holiday or a bank holiday in addition\nto, or in substitution for, any of the days mentioned in the Schedules and\nthereupon this Act shall, in Peninsular Malaysia, or in the Federal Territory,\nor in the State in respect of which a day is appointed to be observed as a\nholiday as aforesaid, be applicable to such day in the same manner as if the\nsaid&nbsp; day had been mentioned in the First Schedule or the Second Schedule,\nas the case may be.<\/p>\n\n\n\n<p><em>Sebaliknya, Seksyen 2 Akta Hari Kelepasan 1951 menyatakan:<\/em><br><em>&#8220;Menteri&#8221; ertinya Menteri yang dipertanggungkan dengan tanggungjawab bagi hari kelepasan am dan hari kelepasan bank.
