(1) Any document which by virtue of these Rules is required to be served on any person need not be served personally unless the document is one which by an express provision of these Rules or by order of the Court is required to be so served.<\/li><\/ul><\/li><\/ul>\n\n\n\n<ul><li><strong>Service of the writ\non individuals <\/strong>&#8211; A writ can\nbe served on an individual defendant through prepaid AR registered post at the\nlast known address <strong>(O. 10, r. 1)<\/strong><\/li><\/ul>\n\n\n\n<p><span style=\"text-decoration: underline;\"><strong>General provisions (O. 10, r. 1)<\/strong><\/span><br>1.&nbsp;&nbsp;&nbsp;&nbsp; (1) Subject to the provisions of any written law and these Rules, a writ shall be served personally on each defendant or sent to each defendant by prepaid A.R. registered post addressed to his last known address and in so far as is practicable, the first attempt at service must be made not later than one month from the date of issue of the writ.<\/p>\n\n\n\n<ul><li><strong>Service on societies<\/strong> \u2013 Serve the writ on the registered address of the society by\nleaving writ there or by sending it by prepaid registered post to the\nregistered address of the society <strong>(O.\n62, r. 6)<\/strong><\/li><li><strong>Service on Trade\nUnions<\/strong> \u2013 s. 37 Trade Unions Act 1959 serve the writ\non the registered office of the trade union either by leaving it there or\nsending it by prepaid registered post <strong>(O.\n62, r. 6)<\/strong><\/li><li><strong>Service of writ on a\npartnership<\/strong> <strong>(O.\n77, r. 3)<\/strong> \u2013 Can be served by prepaid registered post (O. 62, r. 6)<\/li><\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Ordinary service: How effected (O. 62, r. 6)<\/span><\/strong><\/p>\n\n\n\n<p>6.&nbsp;&nbsp;&nbsp;&nbsp; (1) The service of any document, not being a document which in accordance with these Rules is required to be served personally, may be effected-<br>(a) by leaving the document at the proper address of the person to be served;<br>(b) by prepaid registered post;<br>(c) by facsimile in accordance with paragraph (3);<br>(d) in such other manner as may be agreed between the party serving and the party to be served; or<br>(e) in such other manner as the Court may direct<\/p>\n\n\n\n<ul><li><strong>Service of writ on Companies<\/strong> <strong>(O. 62, r. 4(1))<\/strong> \u2013 Writ may be sent by registered post to the business address of the company<ul><li>Registered office \u2013 Personally or post <\/li><li>Principal office \u2013 Registered post only <\/li><\/ul><\/li><li><strong>Service of writ on a foreign company registered in Malaysia (O. 62, r. 4(1)(d))<\/strong> \u2013 Writ may be served by registered post to a person authorized to accept service of documents <\/li><\/ul>\n\n\n\n<p><strong><span style=\"text-decoration: underline;\">Service on corporation (O. 62, r. 4)<\/span><\/strong><br>4.&nbsp;&nbsp;&nbsp;&nbsp; (1) Where an action is against a corporation, the writ may be served-<br>(a) by leaving a copy of it at the registered office (if any) of the corporation;<br>(b) by sending a copy of it by registered post addressed to the corporation at the office, or, if there are more offices than one at the principal office of the corporation, whether such office is situated within Malaysia or elsewhere;<br>(c) by handing a copy of it to the secretary or to any director or other officer of the corporation; or<br>(d) in the case of a foreign company registered under Part XI of the Companies Act 1965 [Act 125] by handing a copy of it to, or sending the same by registered post to, a person authorized to accept service of process on behalf of the foreign company.<\/p>\n\n\n\n<ul><li><strong>Service of writ on agent of overseas principal (O. 10, r. 2)<\/strong><ul><li>(3) Where an order is made under this rule authorizing service of a writ on a defendant&#8217;s agent, a copy of the order and the writ shall be sent by post to the defendant at his address out of the jurisdiction. <\/li><\/ul><\/li><li><strong>Notice of seizure and inventory<\/strong> <strong>(O. 46, r. 16)<\/strong><br>(3) The notice of seizure under paragraph (1) and notice of removal and inventory under paragraph (2) may be\u2014<br>(a) Handed to the execution debtor personally;<br>(b) Sent to him by post to his place of residence;
