{"id":6890,"date":"2020-03-10T17:29:05","date_gmt":"2020-03-10T09:29:05","guid":{"rendered":"http:\/\/alexchanglaw.com\/?p=6890"},"modified":"2024-11-29T17:46:02","modified_gmt":"2024-11-29T09:46:02","slug":"opportunity-witness-execution-writ-seizure-sale-tan-jo-lynn","status":"publish","type":"post","link":"https:\/\/alexchanglaw.com\/index.php\/opportunity-witness-execution-writ-seizure-sale-tan-jo-lynn\/","title":{"rendered":"An Opportunity to Witness the Execution of a Writ of Seizure and Sale by Tan Jo Lynn"},"content":{"rendered":"\n<p><a href=\"https:\/\/alexchanglaw.com\/index.php\/opportunity-witness-execution-writ-seizure-sale-chinese\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u4e2d\u6587\u7248<\/a><\/p>\n\n\n\n<p><strong>Enforcement of Judgment Sum via Writ of Seizure &amp; Sale (WSS)<\/strong><\/p>\n\n\n\n<p>Once judgment is obtained in your favour against\nthe Judgment Debtor, the Judgment Debtor shall obey the terms of judgment and\nwhere debt and other costs are to be paid by the Judgment Debtor, the party\nshall settle the judgment sum. Upon failure to do so, the Judgment Creditor may\nfile an application for writ of seizure and sale whereby once application is\ngranted, the Bailiff would seize and sell off the Judgment Debtor\u2019s property to\nsatisfy the judgment sum. Once to property is sold off, the proceed would go to\nthe Judgment Creditor. <\/p>\n\n\n\n<p><strong>Opportunity to Witness Execution of WSS<\/strong><\/p>\n\n\n\n<p>The case concerned a supplier who\nsupplied medical supplies to the debtor\u2019s pharmacy. Judgment was obtained\nagainst the debtor which led to the enforcement of judgment sum in the form of\nwrit of seizure and sale. <\/p>\n\n\n\n<p>At the beginning, the situation was\nintense as when the Bailiff informed the debtor of the execution the debtor\nseemed shocked and anxious and claimed that she did not expect any form of\nexecution. She became hard to deal with when she refused to write her details\nand sign a form. She came up with different kinds of excuses such as, she did\nnot understand what is stated in the form. Fellow pupil and I tried explaining\nto her the contents of the form. Also, she said that she wasn\u2019t able to write\nas her hands were trembling. We then asked her to stamp her thumb print on the\nform as she refused to write her name in the form. I personally think that all\nthose dramas were intentionally done by her to delay time. Nonetheless, work\nstill has to be done so after some negotiations and telephone calls to our Mr\nAlex Chang, she finally cooperated with us. She signed documents needed to be signed\nand even wrote a lengthy written statement that we asked her to in order to\nshow that she agreed to the settlement terms without any apparent physical\ndisabilities and she spoke to us fluently without any impediments. <\/p>\n\n\n\n<p>As she wanted a settlement, we contacted\nMr Alex Chang so that he could give us further instructions on how to proceed\nthe matter. Mr Alex Chang proposed that she pays the total judgment sum on the\nspot but she claimed that she could only transfer a certain amount through\nonline banking. Well, wise of Mr Alex Chang to subsequently propose that she\npays a certain amount of sum over a certain period of time while the seizure\nstill proceed. The terms agreed was that the debtor was to pay the full amount\nover a period of time including interests and costs failure to do so within the\ntime period will cause the Judgment Debtor\u2019s seized items to be auctioned and\nproceeds from the auction will go to the Judgment Creditor.<\/p>\n\n\n\n<p>The Bailiff then proceeded to list down the items that were to be seized on his inventory list. The items on the list are mostly furniture such as cupboards, shelves and table fan. Then after, some documents were signed. Hopefully she fulfils her obligation to pay up the settlement sum.
