Mahkamah boleh menganggap bahawa syarikat tidak mampu melunaskan hutang jika perkara berikut berlaku:<\/h3>\n

The court\u00a0 may\u00a0 presume that a company as being unable to pay its debts if any of the following occurs:<\/em><\/p>\n

Pemiutang (boleh dengan tugasan), jika memberi hutang lebih daripada RM500 (ya hanya RM500) membawa satu tuntutan statutori (biasanya dipanggil notis 218) untuk hutang tertunggak dan yang tidak dibayar atau tidak dicagar, atau tidak dikompaun sewajarnya, dalam masa tiga minggu.<\/h3>\n
