Definition of Writ of Seizure and Sale<\/em><\/p>\n

Writ penyitaan dan penjualan adalah apa yang kita anggap sebagai mod yang paling berkesan untuk penguatkuasaan penghakiman wang.<\/h3>\n

The Writ of Seizure and Sale (WSS) is what we regard as  the most effective  mode for the enforcement of a money judgment.<\/em><\/p>\n

Writ adalah arahan kepada Syerif untuk merampas harta boleh alih dalam pelaksanaan daripada Penghutang penghakiman dalam Malaysia sebagaimana mencukupi untuk memuaskan jumlah hutang penghakiman, faedah dan kos pelaksanaan.<\/h3>\n

The writ is a direction to the Sheriff to seize in execution the movable properties of the judgment debtor within Malaysia as may be sufficient to satisfy the amount of the judgment debt, interest and the costs of the execution.<\/em><\/p>\n

Pelaksanaan<\/h3>\n

Writ penyitaan dan penjualan akan memulakan pelaksanaan melalui penyitaan dan selepas itu jualan harta boleh alih penghutang penghakiman. Jualan tersebut biasanya dilaksanakan melalui lelongan awam, dijalankan oleh Syerif atau Pelelong berlesen sebagaimana yang sewajarnya untuk memuaskan. Hutang penghakiman dan Kos pelaksanaan. Lelongan biasanya dijalankan 14 hari selepas penyitaan.<\/h3>\n

The WSS will start the execution  by the seizure and thereafter  sale of the judgment  debtor\u2019s  movable  properties.  The sale is   usually by a public auction, conducted by the Sheriff or a licensed  auctioneer which is  sufficient to satisfy the judgment debt and costs of the execution.   An auction is usually conducted 14 days after seizure.<\/em><\/p>\n

Biasanya sekurang\u2011kurangnya satu kakitangan keselamatan akan dihantar untuk memastikan bahawa Penghutang penghakiman tidak memindahkan harta yang disita.<\/h3>\n

Writ itu selanjutnya mengarahkan Syerif itu untuk membayar plaintif jumlah yang dikenakan (mengurangkan kos dan cajnya sendiri), menyatakan bagaimana dia telah melaksanakannya, dan menghantar satu salinan penyataan itu kepada plaintif.<\/h3>\n

Usually at least one security personnel will be posted to ensure that the judgment debtor does not remove the properties seized. The writ further directs the Sheriff to pay the plaintiff the amount levied (less his own costs and charges), state  how he has executed it, and  send a copy of such statement to the plaintiff.<\/em><\/p>\n

Pemiutang penghakiman boleh menguatkuasakan penghakiman itu melalui petisyen penggulungan terhadap penghutang penghakiman tanpa menggunakan cara pelaksanaan yang lain.<\/h3>\n

The judgment creditor may  enforce the judgment by way of a <\/em>winding-up petition<\/em><\/a> against the judgment debtor without first exhausting  other methods of execution.<\/em><\/p>\n
