Selama ini Harta tersebut menghasilkan pulangan yang banyak. \u201cNasib baik\u201d saya berakhir pada Julai 2016.<\/h3>\n<p><em>\u00a0Luck favoured me and\u00a0 I\u00a0 am the proud\u00a0\u00a0 owner of a condominium in Cheras (hereinafter the \u201cProperty\u201d),\u00a0\u00a0 all these years the Property yielded a handsome return.\u00a0\u00a0\u00a0\u00a0 Luck ran out\u00a0\u00a0\u00a0 from July 2016.<\/em><\/p>\n<p>\u8fd0\u6c14\u5c31\u5728\u6211\u8fd9\u4e00\u8fb9\uff0c\u6211\u662f\u4f4d\u4e8e\u8549\u8d56\uff08Cheras\uff09\u7684\u4e00\u95f4\u516c\u5bd3\uff08\u4ee5\u4e0b\u7b80\u79f0\u201c\u7269\u4e1a\u201d\uff09\u7684\u9a84\u50b2\u62e5\u6709\u8005\u3002\u8fd9\u4e9b\u5e74\u6765\uff0c\u8be5\u7269\u4e1a\u5e26\u6765\u4e86\u53ef\u89c2\u7684\u56de\u62a5\u3002\u8fd0\u6c14\u4ece2016\u5e747\u6708\u8d77\u82b1\u5149\u4e86\u3002<\/p>\n<h3>2\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Penyewa tersebut memberitahu saya tentang kesukaran kewangannya dan dia menjangka dapat wang dalam masa beberapa hari dan berjanji akan menyelesaikan semua sewa tertunggak. Walau bagaimanapun hari itu tidak datang. Semua janji\u00a0daripada Penyewa itu\u00a0 tidak mendatangkan apa-apa kecuali kekecewaan.<\/h3>\n<p><em>The Tenant told\u00a0 me about his financial difficulties that\u00a0 he would\u00a0 be expecting some money within a few days and promised to settle all of the rental in arrears.\u00a0\u00a0 However that\u00a0 day never came.\u00a0 All the Tenant\u2019s promises yielded nothing\u00a0 but disappointments.<\/em><\/p>\n<p>\u79df\u6237\u544a\u8bc9\u6211\u4ed6\u7684\u8d22\u52a1\u56f0\u96be\uff0c\u4ed6\u5c06\u5728\u51e0\u5929\u4e4b\u5185\u5f97\u5230\u4e00\u4e9b\u94b1\uff0c\u5e76\u7b54\u5e94\u507f\u8fd8\u6240\u6709\u62d6\u6b20\u7684\u79df\u91d1\u3002\u4f46\u662f\u90a3\u5929\u6ca1\u6709\u5230\u6765\u3002\u79df\u6237\u7684\u6240\u6709\u8bfa\u8a00\u5e26\u6765\u7684\u53ea\u6709\u5931\u671b\u3002<\/p>\n<h3>Penyewa-Sub Mengumpulkan Sewa ke dalam Poket Mereka<\/h3>\n<h3>3\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Selain daripada sewa tertunggak, Penyewa belum pernah membayar Utiliti Harta, diibaratkan menambah garam pada luka, Penyewa tersebut telah \u201csubsewa\u201d harta tersebut dan mengutip sewa daripada Pihak Ketiga tanpa izin dan pengetahuan saya.<\/h3>\n<p><em>Sub-Let Collecting Rentals and Pocketing Them<\/em><\/p>\n<p><em>3 \u00a0\u00a0 \u00a0<\/em><em>Apart from the rental in arrears,\u00a0\u00a0\u00a0 the Tenant had not been paying the utilities of the Property, to add salt to injury,\u00a0\u00a0 the Tenant had\u00a0 \u201csub-let\u201d the Property\u00a0 and was\u00a0 collecting rent from Third \u00a0Property\u00a0 and was\u00a0 collecting rent from Third Parties without my consent and knowledge.<\/em><\/p>\n<p>\u5206\u79df\u6536\u53d6\u79df\u91d1\u5e76\u5c06\u5176\u6536\u5165\u53e3\u888b\u4e2d<\/p>\n<p>3\u9664\u4e86\u62d6\u6b20\u7684\u79df\u91d1\u5916\uff0c\u79df\u6237\u4e5f\u6ca1\u6709\u652f\u4ed8\u7269\u4e1a\u7684\u57fa\u7840\u8bbe\u65bd\u8d39\u7528\uff0c\u7ed9\u4f24\u53e3\u6492\u76d0\u7684\u662f\uff0c\u79df\u6237\u8fd8\u201c\u5206\u79df\u201d\u4e86\u8be5\u7269\u4e1a\uff0c\u5e76\u5728\u672a\u7ecf\u6211\u5141\u8bb8\u548c\u6211\u4e0d\u77e5\u60c5\u7684\u60c5\u51b5\u4e0b\u5411\u7b2c\u4e09\u65b9\u6536\u53d6\u4e86\u79df\u91d1\u3002<\/p>\n<h3>Writ Distres dan Pengusiran<\/h3>\n<h3>4\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Tetuan Alex Chang &amp; Co menasihati saya untuk mendapatkan Writ DIstres terhadap Penyewa dalam masa beberapa minggu. Satu Perintah Mahkamah telah diberikan. Pada hari penyitaan aset Penyewa, kami mendapat tahu bahawa nilai aset dalam Harta tersebut tidak dapat memuaskan sewa dan utiliti tunggakan.<\/h3>\n<p><em>Messrs Alex Chang &amp; Co advised me to obtain\u00a0 a\u00a0\u00a0 Writ of Distress against the Tenant and within a few weeks, a\u00a0 Court Order was granted.\u00a0\u00a0\u00a0 On the day of the seizure of the assets\u00a0 of the Tenant,\u00a0\u00a0 we found out that\u00a0\u00a0 the value of the\u00a0 assets\u00a0 in the Property\u00a0 could barely satisfy the rental and the utilities in arrears.<\/em><\/p>\n<p>\u6263\u62bc\u8d22\u4ea7\u4ee4\u548c\u9a71\u9010<\/p>\n<p>4 Alex Chang\uff06Co\u5f8b\u5e08\u4e8b\u52a1\u6240\u5efa\u8bae\u6211\u83b7\u53d6\u5bf9\u79df\u6237\u7684\u6263\u62bc\u8d22\u4ea7\u4ee4\uff0c\u5e76\u5728\u51e0\u5468\u5185\u83b7\u51c6\u5ead\u4ee4\u3002\u5728\u67e5\u5c01\u79df\u6237\u8d44\u4ea7\u5f53\u5929\uff0c\u6211\u4eec\u53d1\u73b0\u8be5\u7269\u4e1a\u4e2d\u8d44\u4ea7\u7684\u4ef7\u503c\u51e0\u4e4e\u65e0\u6cd5\u6ee1\u8db3\u5176\u62d6\u6b20\u7684\u79df\u91d1\u548c\u57fa\u7840\u8bbe\u65bd\u8d39\u7528\u3002<\/p>\n<h3>4.1\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Kami meneruskan penyitaan itu kerana harapan terakhir saya ialah pengusiran penyewa ingkar daripada Harta saya.<\/h3>\n<p><em>We proceeded with the seizure as my ultimate\u00a0 wish is the\u00a0 eviction of a defaulting tenant from my Property.<\/em><\/p>\n<p>4.1\u6211\u4eec\u8fdb\u884c\u4e86\u67e5\u5c01\uff0c\u56e0\u4e3a\u6211\u7684\u6700\u7ec8\u7684\u613f\u671b\u662f\u4ece\u6211\u7684\u7269\u4e1a\u4e2d\u9a71\u9010\u4e00\u540d\u8fdd\u7ea6\u7684\u79df\u6237<\/p>\n<h3>5\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Bailif itu memberitahu Penyewa tersebut bahawa melainkan pembayaran dilakukan untuk menyelesaikan\u00a0 sewa tertunggak, aset-aset dalam Harta tersebut akan dijual dalam lelongan awam. Percubaan untuk menyelesaikannya dibuat, sekali lagi saya berakhir dengan kekecewaan.<\/h3>\n<p><em>The Bailiff then informed the Tenant that\u00a0\u00a0 unless payment is made to settle the rental in arrears, the assets in the Property\u00a0 will be sold in a public auction.\u00a0\u00a0 Attempts to settle were made, again I ended in disappointment.<\/em><\/p>\n<p>5\u6267\u884c\u5b98\u968f\u540e\u544a\u77e5\u79df\u6237\uff0c\u9664\u975e\u652f\u4ed8\u6b3e\u9879\u7ed3\u6e05\u62d6\u6b20\u7684\u79df\u91d1\uff0c\u5426\u5219\u8be5\u7269\u4e1a\u7684\u8d44\u4ea7\u5c06\u901a\u8fc7\u516c\u5f00\u62cd\u5356\u51fa\u552e\u3002\u548c\u89e3\u7684\u5c1d\u8bd5\u5df2\u505a\u51fa\uff0c\u6211\u518d\u6b21\u4ee5\u5931\u671b\u800c\u544a\u7ec8\u3002<\/p>\n<h3>Lelong : Pemulihan Sewa dan Utiliti<br \/>\n6 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Pada hari lelongan awam, Penyewa sekali lagi meminta masa tetapi Bailif meneruskan lelongan awam.<\/h3>\n<p><em>\u00a0On the day of the public auction, again the Tenant\u00a0\u00a0 pleaded for time however\u00a0\u00a0 the Bailiff\u00a0 proceed with the\u00a0 public auction.<\/em><\/p>\n<p>\u62cd\u5356\uff1a\u56de\u5fa9\u79df\u91d1\u548c\u57fa\u7840\u8bbe\u65bd\u8d39\u7528<\/p>\n<p>6\u5728\u516c\u5f00\u62cd\u5356\u5f53\u5929\uff0c\u79df\u6237\u518d\u6b21\u8bf7\u6c42\u65f6\u95f4\uff0c\u4f46\u662f\u6267\u884c\u5b98\u7ee7\u7eed\u8fdb\u884c\u516c\u5f00\u62cd\u5356\u3002<\/p>\n<h3>6.1 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Selepas keputusan dibuat, semua harta Penyewa telah dijual kepada pembida tertinggi; saya berjaya membersihkan unit barang-barang milik penyewa.<\/h3>\n<p><em>At the fall of the hammer all the possessions of the Tenants were sold to the highest bidder; I managed to clear the unit of the belongings of the tenant<\/em>.<\/p>\n<p>6.1\u843d\u9524\u90a3\u4e00\u523b\uff0c\u79df\u6237\u7684\u6240\u6709\u8d22\u7269\u90fd\u5356\u7ed9\u4e86\u51fa\u4ef7\u6700\u9ad8\u7684\u4eba\uff1b\u6211\u8bbe\u6cd5\u6e05\u9664\u4e86\u79df\u6237\u7684\u8d22\u7269\u5355\u4f4d\u3002<\/p>\n<h3>6.2\u00a0 \u00a0 \u00a0 \u00a0 \u00a0 Hanya sejam selepas lelongan, Penyewa itu membayar jumlah sewa tertunggak seperti yang dinyatakan di Writ Distres.
