The Prime Minister was teasing the crowd, saying it was not easy to declare a public holiday.\u00a0\u00a0Many Malaysians Employers are surely wondering how the Government can declare a public holiday in Malaysia?<\/span><\/h3>\n<h3><span style=\"color: #333399;\">\u5728\u7b2c\u4e8c\u5341\u4e5d\u5c4a\u4e1c\u5357\u4e9a\u8fd0\u52a8\u4f1a\u83b7\u5f97\u51fa\u8272\u7684\u6210\u7ee9\u540e\uff0c\u9a6c\u6765\u897f\u4e9a\u653f\u5e9c\u5ba3\u5e032017\u5e749\u67084\u65e5\u4e3a\u516c\u5171\u5047\u671f\u3002\u5f53\u65f6\u7684\u9996\u76f8\u8fd8\u98ce\u8da3\u5730\u8c03\u4f83\u9053\uff0c\u5ba3\u5e03\u5047\u671f\u53ef\u4e0d\u662f\u4ef6\u5bb9\u6613\u7684\u4e8b\u3002\u5f88\u591a\u9a6c\u6765\u897f\u4e9a\u7684\u96c7\u4e3b\u4eec\u4e00\u5b9a\u90fd\u5f88\u597d\u5947\uff1a\u00a0\u4e3a\u4f55\u9a6c\u6765\u897f\u4e9a\u653f\u5e9c\u53ef\u4ee5\u81ea\u884c\u5ba3\u5e03\u5047\u671f\uff1f<\/span><\/h3>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #000080;\">We will explain how\u00a0\u00a0the Employers need only to observe 11 days per year of the Gazetted holidays, out of which the employers are free to choose 6 out of the 11 days.\u00a0<\/span><\/h2>\n<h2><span style=\"color: #000080;\">\u6211\u4eec\u4f1a\u89e3\u91ca\uff1a\u96c7\u4e3b\u4eec\u53ea\u9700\u9075\u5b88\u4e00\u5e74\u5341\u4e00\u5929\u7684\u520a\u5baa\u5047\u671f\uff0c\u96c7\u4e3b\u4eec\u53ef\u81ea\u884c\u9009\u62e9\u5f53\u4e2d\u76846\u5929\u5047\u671f\u3002<\/span><\/h2>\n<h2><\/h2>\n<h1><span style=\"color: #003366;\">How many Public Holidays do We have?<\/span><\/h1>\n<h1><span style=\"color: #003366;\">\u6211\u4eec\u53ef\u62e5\u6709\u591a\u5c11\u5929\u7684\u516c\u5171\u5047\u671f\uff1f<\/span><\/h1>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #000080;\">Public Holiday are listed\u00a0\u00a0in the First Schedule of the Holidays Act. The 10 Public Holidays listed in the schedule is observed throughout Malaysia as follows:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u516c\u5171\u5047\u65e5\u5217\u4e8e\u300a\u5047\u65e5\u6cd5\u4ee4\u300b\uff08Holidays Act\uff09\u7684\u7b2c\u4e00\u5217\u8868\uff08first schedule\uff09\u3002\u5f53\u4e2d\u5c31\u6709\u5341\u4e2a\u516c\u5171\u5047\u65e5\u5fc5\u987b\u88ab\u5168\u9a6c\u6765\u897f\u4e9a\u4eba\u6c11\u9075\u5b88\uff0c\u90a3\u5c31\u662f\uff1a<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Chinese New Year\u00a0\u519c\u5386\u65b0\u5e74<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Wesak Day\u00a0\u536b\u585e\u8282<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Hari Raya Aidilfitri 2 days\u00a0\u5f00\u658b\u8282\u00a02\u5929<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Merdeka Day 31 August\u00a0\u56fd\u5e86\u65e5\u00a08\u670831\u65e5<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Hari Raya Haji\u00a0\u54c8\u829d\u8282<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Agong\u2019s Birthday\u00a0\u5143\u9996\u8bde\u8fb0<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Malaysia Day 16 September\u00a0\u9a6c\u6765\u897f\u4e9a\u65e5\u00a09\u670816\u65e5<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Deepavali\u00a0\u5c60\u5996\u8282<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Prophet Muhammad\u2019s Birthday\u00a0\u5148\u77e5\u9ed8\u7f55\u9ed8\u5fb7\u8bde\u8fb0<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Christmas Day 25 December\u00a0\u5723\u8bde\u8282\u00a012\u670825\u65e5<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">It is interesting to note that only one day for Chinese New Year holiday in the States of Kelantan and Terengganu, two days in the other States while two days Hari Raya Haji holiday in the States of Kelantan and Terengganu, one day in the other States.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u6bd4\u8f83\u7279\u522b\u7684\u662f\uff0c\u519c\u5386\u65b0\u5e74\u7684\u5047\u65e5\u5728\u5409\u5170\u4e39\u53ca\u767b\u5609\u697c\u5dde\u53ea\u6709\u4e00\u5929\uff0c\u800c\u5176\u4ed6\u5dde\u5c5e\u5219\u6709\u4e24\u5929\u3002\u76f8\u53cd\u7684\uff0c\u8fd9\u4e24\u4e2a\u5dde\u5c5e\u53ef\u4eab\u6709\u4e24\u5929\u7684\u54c8\u829d\u8282\u5047\u671f\uff0c\u800c\u5176\u4ed6\u5dde\u5c5e\u53ea\u4eab\u6709\u4e00\u5929\u5047\u671f\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Hold On, we have more public Holiday: State Level<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u9664\u6b64\u4e4b\u5916\uff0c\u00a0\u6211\u4eec\u8fd8\u6709\u66f4\u591a\u516c\u5171\u5047\u671f\uff1a\u5dde\u5c5e\u5047\u671f<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">In Malaysia, we have two types of public holidays, those at national and state levels.\u00a0\u00a0National holidays are the abovementioned public holiday, normally observed by most governmental and private organisations.\u00a0\u00a0State holidays are normally observed by certain states in Malaysia or when it is relevant to the state itself according to section 9(1) of the Holidays Act.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u5728\u9a6c\u6765\u897f\u4e9a\uff0c\u00a0\u6211\u4eec\u6709\u4e24\u79cd\u516c\u5171\u5047\u671f-\u5168\u56fd\u5047\u671f\u53ca\u5dde\u5c5e\u5047\u671f\u3002<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u4e0a\u6587\u63d0\u53ca\u7684\u90fd\u662f\u56fd\u5bb6\u5047\u671f\uff0c\u8fd9\u4e9b\u5047\u671f\u901a\u5e38\u90fd\u4f1a\u88ab\u653f\u5e9c\u53ca\u79c1\u4eba\u673a\u6784\u9075\u5b88\u3002\u5dde\u5c5e\u5047\u65e5\u901a\u5e38\u53ea\u88ab\u4e00\u4e9b\u7279\u5b9a\u7684\u5dde\u5c5e\u6216\u5728\u300a\u5047\u65e5\u6cd5\u4ee4\u300b\u6761\u65879\uff081\uff09\u4e0b\u4e0e\u8fd9\u4e9b\u5dde\u5c5e\u6709\u5173\u7cfb\u7684\u673a\u6784\u9075\u5b88\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">As an example let us take Kuala Lumpur, the national capital of the country. Kuala Lumpur celebrates New Year\u2019s Day on January 1, Thaipusam, Nuzul Al-Quran and Awal Muharram.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u4e3e\u4e2a\u4f8b\u5b50\uff0c\u5409\u9686\u5761\uff0c\u6211\u4eec\u7684\u9996\u90fd\u3002\u5409\u9686\u5761\u5e86\u795d\u4e00\u6708\u4e00\u65e5\u7684\u65b0\u5e74\uff0c\u5927\u5b9d\u68ee\u8282\uff0c\u53ef\u5170\u7ecf\u964d\u4e16\u65e5\uff08Nuzul Al-Quran\uff09\u53ca\u7a46\u54c8\u5170\u59c6\u8282\uff08Awal Muharram\uff09\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Kuala Lumpur also celebrates a special holiday called Federal Territory Day along with only two other territories on February 1 according to section 9(2) of the Holidays Act.\u00a0\u00a0Federal Territory Day in Kuala Lumpur celebrates the formation of the territory in 1974.\u00a0\u00a0Prior to that, Kuala Lumpur and the area now known as Putrajaya were under the state of Selangor.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u6839\u636e\u300a\u5047\u65e5\u6cd5\u4ee4\u300b\u6761\u65879\uff082\uff09\uff0c\u5409\u9686\u5761\u548c\u53e6\u5916\u4e24\u4e2a\u8054\u90a6\u76f4\u8f96\u533a\u4e5f\u57282\u67081\u65e5\u5e86\u795d\u9a6c\u6765\u897f\u4e9a\u8054\u90a6\u76f4\u8f96\u533a\u65e5\u3002\u8fd9\u662f\u4e3a\u4e86\u7eaa\u5ff51974\u5e74\u8054\u90a6\u76f4\u8f96\u533a\u7684\u6210\u7acb\u3002\u5728\u8fd9\u4e4b\u524d\uff0c\u5409\u9686\u5761\u548c\u5e03\u7279\u62c9\u518d\u4e5f\u96b6\u5c5e\u4e8e\u96ea\u5170\u83aa\u5dde\u3002<\/span><\/h3>\n<p>&nbsp;<\/p>\n<h1><span style=\"color: #003366;\">The Private Sector: 11 Days to be Observed.\u00a0\u00a0 \u00a0<\/span><\/h1>\n<h1><span style=\"color: #003366;\">\u79c1\u4eba\u9886\u57df\uff1a11\u5929\u7684\u5047\u671f\u5fc5\u987b\u9075\u5b88<\/span><\/h1>\n<h1><\/h1>\n<h3><span style=\"color: #000080;\">5 Compulsory Days\u00a0\u00a0and 6 Elective Days<\/span><\/h3>\n<h3><span style=\"color: #000080;\">5\u5929\u5f3a\u5236\u5047\u671f\uff1b6\u5929\u9009\u62e9\u6027\u5047\u671f<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Fortunately, for the Employers, Section 60D of the Employment Act only provides every employees to be entitled to the 11 gazetted public holidays and any day appointed as a public holiday under section 8 of the Holidays Act (for example, September 4, 2017).<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u5bf9\u96c7\u4e3b\u6765\u8bf4\uff0c\u5f88\u5e78\u8fd0\u7684\uff0c\u300a\u9a6c\u6765\u897f\u4e9a\u52b3\u5de5\u6cd5\u4ee4\u300b\u6761\u658760D\u53ea\u63d0\u4f9b\u4e8611\u520a\u5baa\u516c\u5171\u5047\u65e5\u548c\u5728\u300a\u5047\u65e5\u6cd5\u4ee4\u300b\u6761\u65878\u4e0b\u88ab\u5ba3\u5e03\u7684\u5047\u65e5\u7ed9\u96c7\u5458\u3002\uff08\u4f8b\u59822017\u5e749\u67084\u65e5\uff09<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">That is to say employers are not\u00a0\u00a0required to observe these state level holidays.\u00a0\u00a0As such, the employees are still required to work as usual if the employers do not declare these state level holidays as paid holidays.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u76f8\u5bf9\u6765\u8bf4\uff0c\u96c7\u4e3b\u4eec\u5e76\u4e0d\u9700\u8981\u9075\u4ece\u5dde\u5c5e\u5047\u65e5\u3002\u56e0\u6b64\uff0c\u82e5\u96c7\u4e3b\u6ca1\u6709\u5ba3\u5e03\u8fd9\u4e9b\u5dde\u5c5e\u5047\u65e5\u4e3a\u6709\u85aa\u5047\u65e5\uff0c\u96c7\u5458\u4eec\u8fd8\u662f\u5f97\u50cf\u5f80\u5e38\u4e00\u6837\u5de5\u4f5c\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Exceptions are, Federal Territory Day must be observed in the Federal Territory of Kuala Lumpur, Putrajya and Labuan. In other states, the Birthday of the Ruler or the Yang di-Pertua Negeri must be observed.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u4e0d\u540c\u7684\u662f\uff0c\u8054\u90a6\u76f4\u8f96\u533a\u65e5\u5fc5\u987b\u88ab\u5409\u9686\u5761\uff0c\u5e03\u7279\u62c9\u518d\u4e5f\u53ca\u7eb3\u95fd\u7684\u96c7\u4e3b\u9075\u4ece\u3002\u5728\u5176\u4ed6\u7684\u5dde\u5c5e\uff0c\u5dde\u7d71\u6cbb\u8005\u6216\u5dde\u5143\u9996\u7684\u8bde\u8fb0\u5e94\u88ab\u89c6\u4e3a\u516c\u5171\u5047\u671f\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Section 60D provides that the employer must list\u00a0\u00a011 gazetted public holidays that the employees are entitled to before the commencement of each calendar year, 5 of which shall be:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u300a\u9a6c\u6765\u897f\u4e9a\u52b3\u5de5\u6cd5\u4ee4\u300b\u6761\u658760D\u89c4\u5b9a\u96c7\u4e3b\u9700\u5728\u6bcf\u5e74\u4e00\u6708\u4e00\u65e5\u524d\u5217\u660e11\u4e2a\u520a\u5baa\u516c\u5171\u5047\u65e5\uff0c\u5176\u4e2d\u4e94\u4e2a\u5fc5\u987b\u5305\u62ec\uff1a<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">National Day, the Birthday of Yang-Di Pertuan Agong, Birthday of the Ruler or the Yang di-Pertua Negeri or Federal Territory Day, the Worker\u2019s Day and Malaysia Day.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u56fd\u5e86\u65e5\uff0c\u5143\u9996\u8bde\u8fb0\uff0c\u5dde\u7edf\u6cbb\u8005\u6216\u5dde\u5143\u9996\u8bde\u8fb0\u6216\u8054\u90a6\u76f4\u8f96\u533a\u65e5\uff0c\u52b3\u52a8\u8282\u53ca\u9a6c\u6765\u897f\u4e9a\u65e5\u3002<\/span><\/h3>\n<h3><\/h3>\n<h2><span style=\"color: #003366;\">The Employers are free to choose the remaining 6 holidays to make up the 11 days.<\/span><\/h2>\n<h2><span style=\"color: #003366;\">\u96c7\u4e3b\u53ef\u4ee5\u81ea\u7531\u9009\u62e9\u5269\u4e0b\u7684\u516d\u4e2a\u516c\u5171\u5047\u671f\u4ee5\u51d1\u621011\u5929\u3002<\/span><\/h2>\n<h2><\/h2>\n<h3><span style=\"color: #000080;\">This section allows the\u00a0\u00a0employers\u00a0\u00a0to ask the employees to come to work on Chinese New Year, Hari Raya Aidifiltri or Deepavali!\u00a0\u00a0\u00a0As stated earlier, the employer need to list\u00a0\u00a0which 11 gazetted public holiday, if your day is not in the list, you have to\u00a0\u00a0be absent from the table of family gathering.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u8fd9\u4e2a\u6761\u6587\u5141\u8bb8\u96c7\u4e3b\u8981\u6c42\u5458\u5de5\u4e8e\u519c\u5386\u65b0\u5e74\uff0c\u5f00\u658b\u8282\u6216\u5c60\u5996\u8282\u5de5\u4f5c\uff01<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u5982\u4e0a\u6587\u6240\u8bf4\uff0c\u96c7\u4e3b\u9700\u5217\u660e11\u4e2a\u520a\u5baa\u516c\u5171\u5047\u671f\uff0c\u00a0\u82e5\u4f60\u7684\u8282\u65e5\u6ca1\u6709\u88ab\u5217\u5728\u5176\u4e4b\u5185\uff0c\u53ef\u80fd\u4f60\u5c31\u8981\u7f3a\u5e2d\u4f60\u7684\u5bb6\u5ead\u805a\u4f1a\u4e86\u3002<\/span><\/h3>\n<p>&nbsp;<\/p>\n<h1><span style=\"color: #003366;\">The Minister can create more holidays!<\/span><\/h1>\n<h1><span style=\"color: #003366;\">\u90e8\u957f\u53ef\u5236\u9020\u66f4\u591a\u5047\u671f\uff01<\/span><\/h1>\n<h1><\/h1>\n<h3><span style=\"color: #000080;\">The Minister can declare any day as a public holiday according to section 8 of the Holidays Act.\u00a0\u00a0This section basically gives the Minister responsible the power to appoint any day he wants as a public holiday in the Peninsular, the Federal Territories or certain States (after consulting the States).<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u300a\u5047\u65e5\u6cd5\u4ee4\u300b\u6761\u65878\u7ed9\u4e88\u4e86\u90e8\u957f\u5ba3\u5e03\u5047\u65e5\u7684\u6743\u5229\u3002\u7b80\u5355\u6765\u8bf4\uff0c\u8fd9\u6761\u6587\u8ba9\u90e8\u957f\u6709\u6743\u5229\u5b9a\u4e0b\u54ea\u5929\u6210\u4e3a\u516c\u5171\u5047\u671f\u3002\u8fd9\u6761\u6587\u53ea\u9002\u7528\u4e8e\u897f\u9a6c\uff0c\u8054\u90a6\u76f4\u8f96\u533a\u53ca\u7279\u5b9a\u5dde\u5c5e\uff08\u4e0e\u8be5\u5dde\u5c5e\u534f\u5546\u540e\uff09\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Based on the abovementioned section, Prime Minister is the Minister charged with responsibility for public holiday.\u00a0\u00a0He may appoint any date, in our scenario, September 4 as a public holiday.\u00a0\u00a0This can be seen in a statement issued by the Malaysian Prime Minister\u2019s Department has announced that September 4 as a public holiday in appreciation of the outstanding achievement of the Malaysian contingent in 29th Kuala Lumpur SEA Games.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u7efc\u4e0a\u6240\u8ff0\uff0c\u9996\u76f8\u662f\u8d1f\u8d23\u5047\u671f\u4e8b\u5b9c\u7684\u90e8\u957f\u3002\u4ed6\u80fd\u6311\u9009\u4efb\u4f55\u65e5\u5b50\uff0c\u5728\u6211\u4eec\u7684\u60c5\u51b5\u4e0b\uff0c9\u67084\u65e5\u88ab\u5217\u4e3a\u516c\u5171\u5047\u65e5\u3002\u9a6c\u6765\u897f\u4e9a\u9996\u76f8\u7f72\u53d1\u8868\u7684\u6587\u544a\u4e2d\u6307\u51fa\uff0c\u9996\u76f8\u7f72\u5ba3\u5e039\u67084\u65e5\u4e3a\u516c\u5171\u5047\u671f\u4ee5\u6b22\u5e86\u9a6c\u6765\u897f\u4e9a\u961f\u5458\u572829\u5c4a\u4e1c\u5357\u4e9a\u8fd0\u52a8\u4f1a\u4e2d\u53d6\u5f97\u7684\u4f73\u7ee9\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">This holiday is a national holiday and observed throughout Malaysia by the public sector and\u00a0\u00a0the private sector.\u00a0\u00a0Private sector is governed by Employment Act 1955.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u8fd9\u662f\u4e00\u4e2a\u56fd\u5bb6\u5047\u671f\u56e0\u6b64\u5fc5\u987b\u88ab\u5168\u9a6c\u7684\u79c1\u4eba\u4ee5\u53ca\u653f\u5e9c\u673a\u6784\u9075\u4ece\u3002\u79c1\u4eba\u673a\u6784\u7684\u8fd0\u4f5c\u5904\u4e8e\u300a\u52b3\u5de5\u6cd5\u4ee4\u300b\u7684\u7ba1\u8f96\u4e0b\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">It is important to note that the Employment Act only applies to Peninsular Malaysia or West Malaysia.\u00a0\u00a0Sabah and Sarawak, collectively called East Malaysia, have maintained separate labour enactments.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u503c\u5f97\u6ce8\u610f\u7684\u662f\uff0c\u300a\u52b3\u5de5\u6cd5\u4ee4\u300b\u53ea\u9002\u7528\u4e8e\u897f\u9a6c\u534a\u5c9b\u6216\u897f\u9a6c\u3002\u6c99\u5df4\u53ca\u7802\u62c9\u8d8a\uff0c\u7edf\u79f0\u4e1c\u9a6c\uff0c\u6709\u81ea\u5df1\u7684\u4e00\u5957\u52b3\u5de5\u5f8b\u6cd5\u3002<\/span><\/h3>\n<p>&nbsp;<\/p>\n<h2><span style=\"color: #003366;\">Can the employer asks the employees to work on a Declared Public Holiday?<\/span><\/h2>\n<h2><span style=\"color: #003366;\">\u96c7\u4e3b\u53ef\u4ee5\u8ba9\u52b3\u5de5\u5728\u653f\u5e9c\u5ba3\u5e03\u7684\u516c\u5171\u5047\u671f\u5de5\u4f5c\u65e5\u5417\uff1f<\/span><\/h2>\n<h2><\/h2>\n<h3><span style=\"color: #000080;\">Under Section 60 of Employment Act, an employee may be required to work on any paid holiday subjected to two days\u2019 wages at the ordinary rate of pay.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">In addition, section 60D 3(b) provides that an employee who works on a holiday shall be entitled to a travelling allowance for that day if payable to him under the terms of his agreement with his employer but such employee shall not be entitled under this subsection to receive an increased rate of any housing allowance or food allowance.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">Employer may be fined if does not grant leave.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u300a\u52b3\u5de5\u6cd5\u4ee4\u300b\u6761\u658760D\u6307\u51fa\uff0c\u5728\u4efb\u4f55\u6709\u85aa\u5047\u671f\u5de5\u4f5c\u7684\u96c7\u5458\u53ef\u4eab\u6709\u53cc\u500d\u666e\u901a\u65e5\u7684\u5de5\u8d44\u3002<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u9664\u6b64\u4e4b\u5916\uff0c\u6761\u658760D 3\uff08b\uff09\u6307\u51fa\u539f\u672c\u5728\u96c7\u4f63\u5408\u7ea6\u91cc\u4eab\u7528\u4ea4\u901a\u6d25\u8d34\u7684\u96c7\u5458\uff0c\u82e5\u5728\u6709\u85aa\u516c\u5171\u5047\u671f\u5de5\u4f5c\uff0c\u4f9d\u7136\u80fd\u4eab\u6709\u8be5\u6d25\u8d34\u3002\u4f46\u6b64\u6761\u6587\u4e0d\u9002\u7528\u4e8e\u589e\u52a0\u4f19\u98df\u6d25\u8d34\u53ca\u4f4f\u5bbf\u6d25\u8d34\u3002<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u82e5\u4e0d\u8ba9\u5458\u5de5\u653e\u5047\uff0c\u96c7\u4e3b\u5c06\u88ab\u7f5a\u6b3e\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">In the previous installation of Sultan Muhammad V from Kelantan as Malaysia\u2019s 15th Yang di-Pertuan Agong, Malaysian Employers Federation (MEF) executive director Datuk Shamsuddin Bardan has said that employers who do not grant leave on 24 April could face a\u00a0\u00a0\u00a0fine as according to section 99A of the Employment Act. Meanwhile, Malaysian Trades Union Congress (MTUC) president Abdul Halim Bin Mansor said that government and private offices in every state should comply to the holiday as a sign of respect.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u65e9\u524d\uff0c\u5728Sultan Muhammad\u00a0\u4e94\u4e16\u4e8e\u5409\u5170\u4e39\u4e3e\u884c\u7684\u7b2c\u5341\u4e94\u4efb\u56fd\u5bb6\u5143\u9996\u767b\u57fa\u5178\u793c\u65f6\uff0c\u9a6c\u6765\u897f\u4e9a\u96c7\u4e3b\u8054\u76df\uff08MEF\uff09\u6267\u884c\u8463\u4e8b\u00a0Datuk Shamsuddin Bardan\u6307\u51fa\u4e0d\u8ba9\u96c7\u5458\u57284\u670824\u65e5\u653e\u5047\u7684\u96c7\u4e3b\u5c06\u5728\u300a\u52b3\u5de5\u6cd5\u4ee4\u300b99A\u7684\u6761\u6587\u4e0b\u88ab\u7f5a\u6b3e\u3002<\/span><\/h3>\n<h3><span may have plans on\u00a0\u00a0September 4.\u00a0\u00a0\u00a0The employer may grant the employee any other day as a paid public holiday in substitution for any of the public holidays according to Section 60D (1A) of the Employment Act.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u4e00\u4e9b\u516c\u53f8\u53ef\u80fd\u57289\u67084\u65e5\u4e3e\u529e\u6d3b\u52a8\u3002\u96c7\u4e3b\u53ef\u4ee5\u7ed9\u4e88\u96c7\u5458\u5176\u4ed6\u65e5\u5b50\u4ee5\u66ff\u4ee3\u8be5\u6709\u85aa\u5047\u671f\uff0c\u5728\u300a\u52b3\u5de5\u6cd5\u4ee4\u300b\u6761\u658760D\uff081A\uff09\u7684\u7ba1\u8f96\u4e0b\u3002<\/span><\/h3>\n<h3><\/h3>\n<h1><span style=\"color: #003366;\">Conclusion<\/span><\/h1>\n<h1><span style=\"color: #003366;\">\u7ed3\u8bba<\/span><\/h1>\n<p>&nbsp;<\/p>\n<h3><span style=\"color: #000080;\">There are only 11 days of paid Public Holidays, out of which the employers may choose 6 out of 11,\u00a0\u00a0there are some special holidays the Minister may declare from time to time as special holidays.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u6709\u85aa\u516c\u5171\u5047\u671f\u53ea\u670911\u5929\uff0c\u96c7\u4e3b\u80fd\u81ea\u7531\u9009\u62e9\u5176\u4e2d\u76846\u5929\uff0c\u6b64\u5916\u90e8\u957f\u4eec\u4e5f\u80fd\u5c06\u4e00\u4e9b\u7279\u522b\u7684\u65e5\u5b50\u5ba3\u5e03\u4e3a\u5047\u671f\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">However, the employers may nominate a replacement day for these holidays declared at short notice.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u4f46\u662f\uff0c\u96c7\u4e3b\u4eec\u5374\u53ef\u4ee5\u4e00\u5176\u4ed6\u65e5\u5b50\u6765\u66ff\u4ee3\u8fd9\u4e9b\u4e34\u65f6\u88ab\u5ba3\u5e03\u7684\u516c\u5171\u5047\u671f\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">If the employers should require the employees to work during those holidays declared by the minister, the rate of pay is that of a public holiday.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u82e5\u96c7\u4e3b\u60f3\u8981\u8ba9\u96c7\u5458\u5728\u8fd9\u4e9b\u88ab\u5ba3\u5e03\u4e3a\u516c\u5171\u5047\u671f\u7684\u65e5\u5b50\u5de5\u4f5c\uff0c\u4ed6\u4eec\u7684\u85aa\u6c34\u5e94\u8be5\u548c\u5728\u6709\u85aa\u5047\u671f\u671f\u95f4\u5de5\u4f5c\u7684\u4e00\u6837\uff0c\u5373\u4e24\u500d\u65e5\u5e38\u5de5\u8d44\u3002<\/span><\/h3>\n<p>&nbsp;<\/p>\n<h2><span legislated matters pertaining to public holiday in Malaysia are as follows:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u4e0e\u9a6c\u6765\u897f\u4e9a\u516c\u5171\u5047\u671f\u6709\u5173\u7684\u4e3b\u8981\u6cd5\u4ee4\uff1a<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Section 3 of Interpretation Act 1948 And 1967 states:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u7ffb\u8bd1\u6cd5\u4ee41948\u00a0\u6761\u65873 \u53ca \u7ffb\u8bd1\u6cd5\u4ee41967\u00a0\u6307\u51fa\uff1a<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">\u201cpublic holiday\u201d means a public holiday established by law in Malaysia or any part of Malaysia.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u201c\u516c\u5171\u5047\u671f\u201d\u4ee3\u8868\u9a6c\u6765\u897f\u4e9a\u4efb\u4f55\u5730\u533a\u6cd5\u5b9a\u7684\u516c\u5171\u5047\u671f<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u201cMinister\u201d means, subject to subsection 8(2), a Minister of the Government of Malaysia (including the Prime Minister and a Deputy Minister);<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u201c\u90e8\u957f\u201d\uff0c\u6839\u636e\u6761\u65878\uff082\uff09\uff0c\u4ee3\u8868\u9a6c\u6765\u897f\u4e9a\u653f\u5e9c\u90e8\u957f\uff08\u5305\u62ec\u9996\u76f8\u53ca\u526f\u90e8\u957f\uff09<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Also, Section 8(2) of Interpretation Acts 1948 And 1967 states:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">References to \u201cthe High Court\u201d, \u201cthe Minister\u201d and \u201cthe Treasury\u201d<\/span><\/h3>\n<h3><span style=\"color: #000080;\">(2) A reference to \u201cthe Minister\u201d is a reference to the Minister for the time being responsible for the matter in connection with which the reference is made.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u6761\u65878\uff082\uff09\u7ffb\u8bd1\u6cd5\u4ee41948 \u53ca 1967\u6307\u51fa\uff1a<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u53c2\u8003\u201c\u9ad8\u5ead\u201d\u3001\u201c\u90e8\u957f\u201d\u53ca\u00a0\u201c\u8d22\u653f\u90e8\u957f\u201d<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\uff082\uff09\u201c\u90e8\u957f\u201d\u6307\u7684\u662f\u5728\u6307\u5b9a\u65f6\u95f4\u5185\u4e3a\u6307\u5b9a\u9886\u57df\u8d1f\u8d23\u7684\u90e8\u957f\u3002<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">In turn, Section 2 of the Holidays Act 1951 states:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u53e6\u4e00\u65b9\u9762\uff0c\u300a\u5047\u65e5\u6cd5\u4ee4\u300b\u6761\u65872\u6307\u51fa:<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">\u201cMinister\u201d means the Minister charged with the responsibility for public and bank holidays.And, Section 8 of the Holidays Act 1951 provides that:<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u201c\u90e8\u957f\u201d\u4ee3\u8868\u4e3a\u516c\u5171\u53ca\u94f6\u884c\u5047\u671f\u8d1f\u8d23\u7684\u90e8\u957f\u3002\u6761\u65878\u4e5f\u6307\u51fa:<\/span><\/h3>\n<h3><\/h3>\n<h3><span style=\"color: #000080;\">Minister may appoint special days to be observed as bank or public holidays.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">The Minister may, by notification in the Gazette or in such other manner as he thinks fit, appoint, in respect of Peninsular Malaysia, or the Federal Territory or, after consultation with the State Authority, in respect of a State, a day to be observed as a public holiday or a bank holiday in addition to, or in substitution for, any of the days mentioned in the Schedules and thereupon this Act shall, in Peninsular Malaysia, or in the Federal Territory, or in the State in respect of which a day is appointed to be observed as a holiday as aforesaid, be applicable to such day in the same manner as if the said\u00a0\u00a0day had been mentioned in the First Schedule or the Second Schedule, as the case may be.<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u90e8\u957f\u4e0d\u5e94\u8be5\u5c06\u7279\u522b\u7684\u65e5\u5b50\u6307\u5b9a\u4e3a\u94f6\u884c\u6216\u516c\u5171\u5047\u671f\u3002<\/span><\/h3>\n<h3><span style=\"color: #000080;\">\u901a\u8fc7\u53d1\u8868\u6587\u544a\u6216\u5176\u4ed6\u65b9\u6cd5\uff0c\u90e8\u957f\u80fd\u591f\u5728\u4e8e\u5dde\u653f\u5e9c\u534f\u5546\u540e\uff0c\u5236\u5b9a\u4e00\u4e2a\u96b6\u5c5e\u4e8e\u5dde\u5c5e\u5047\u671f\u7684\u516c\u5171\u53ca\u94f6\u884c\u5047\u671f\uff0c\u9002\u7528\u4e8e\u897f\u9a6c\u53ca\u8054\u90a6\u76f4\u8f96\u533a\uff0c\u5305\u62ec\u4efb\u4f55\u6cd5\u4ee4\u5217\u8868\u4e2d\u7684\u65e5\u5b50\uff0c\u5c31\u7b97\u5176\u5df2\u7ecf\u88ab\u5217\u4e3e\u5728\u7b2c\u4e00\u5217\u8868\u6216\u7b2c\u4e8c\u5217\u8868\u91cc\uff0c\u4f5c\u4e3a\u897f\u9a6c\uff0c\u8054\u90a6\u76f4\u8f96\u533a\u6216\u4efb\u4f55\u4e00\u5468\u7684\u516c\u5171\u5047\u671f\u3002<\/span><\/h3>\n<h3><\/h3>\n<h2><span
