Automatic Discharge In the New Insolvency Act 2016<\/span><\/h3>\n\n\n\n
“Insolvency Act\u201d\u662f 1967\u5e74\u201cBankruptcy Act” \u7684\u65b0\u540d\u79f0\uff0c
\u4ecb\u7ecd\u4e86\u4e00\u4e2a\u65b0\u7684\u6761\u6b3e\uff0c\u7834\u4ea7\u4eba\u5728\u63d0\u4ea4\u5176\u9648\u8ff0\u4e66\u4e4b\u65e5\u8d77\u4e09\u5e74\u540e\uff0c\u5c06\u88ab\u81ea\u52a8\u89e3\u9664\u7834\u4ea7; \u4f46\u7834\u4ea7\u4eba\u5fc5\u987b \u5df2\u8fbe\u6210\u7834\u4ea7\u603b\u76d1\u786e\u5b9a\u7684\u76ee\u6807\u7f34\u6b3e\uff0c\u503a\u6743\u4eba\u7684\u53cd\u5bf9\u548c\u7834\u4ea7\u4eba\u9075\u5b88\u8d22\u4ea7\u548c\u8d22\u4ea7\u8d26\u76ee\u7684\u89c4\u5b9a\u3002<\/h5>\n\n\n\nThe Insolvency Act which is the new name of the Bankruptcy Act 1967, introduced a new section, where a bankrupt shall be discharged from bankruptcy after three years from the date of the submission of his statement of affairs;
subject to the condition that the bankrupt has achieved the target contribution determined by the Director General of Insolvency, objection by creditors and the bankrupt’s compliance with the requirement to render an account of moneys and property.<\/h5>\n\n\n\n3 main ways bankruptcy is terminated:<\/span><\/h3>\n\n\n\n
(a) Making an application in court at any time for the bankruptcy order to be annulled on grounds
i.e. debt has been paid in full or that he ought not to be made a bankrupt on some technical
grounds;<\/p>\n\n\n\n(b) Making an application in court at any time for a court discharge.<\/p>\n\n\n\n
(c) A discharge at the discretion of the Director General of Insolvency.<\/p>\n\n\n\n

Whether it is discharged or annulled will depend on the circumstances. In most case you need to find out who are the creditors who have filed the proof of debts against the Bankrupt. A negotiation with the Creditors may be necessary.<\/p>\n\n\n\n
