Litigation in Textbook and in Practice – A Comparison<\/strong><\/h3>\n

After I\u00a0 have\u00a0 completed\u00a0 my journey\u00a0 in the\u00a0 university,\u00a0 I\u00a0 was given an opportunity to undergo\u00a0 a short \u00a0attachment\/ internship\/ mini-pupillage at\u00a0 Alex Chang & Co\u00a0\u00a0 to experience\u00a0\u00a0\u00a0 litigation\u00a0 in a\u00a0 commercial litigation firm.\u00a0\u00a0 During the tenure of my internship, I was tasked to review\u00a0\u00a0 some files\u00a0 to have a\u00a0 better insight of\u00a0 litigation practice.\u00a0\u00a0\u00a0 Now\u00a0 I understand\u00a0 that there is huge disparity between litigation in textbook and\u00a0 in practice.<\/p>\n

The first file I read was a ‘trial’ file.\u00a0\u00a0 What I understand\u00a0 from the Civil Procedure course was that trial\u00a0 proceedings are governed by Writs\u00a0 under Order 5 rule 2 of the Rules of Court 2012.<\/p>\n

However,\u00a0 this is the first time for me to\u00a0 read a\u00a0\u00a0 litigation\u00a0 file,\u00a0\u00a0 I was not given the same opportunity in the other internship.\u00a0 I was in awe by the sheer\u00a0 thickness of the bundles\u00a0 and the number of documents.<\/p>\n<\/blockquote>\n

Before I started my read,\u00a0\u00a0 Mr. Alex Chang gave me some tips and a short briefing.\u00a0 I found out that one should\u00a0\u00a0 always start reading the pleadings\u00a0\u00a0 to have better understanding of the background facts and the plea of the parties.\u00a0\u00a0\u00a0 I\u00a0 made an interesting discovery which I would never have found in the text books…\u00a0\u00a0 Every bundle\u00a0 in\u00a0 the Record of Appeal\u00a0\u00a0 shall start with five blank papers, there are\u00a0 bundling and indexing regulations.<\/p>\n

The next challenge\u00a0 I encountered was the\u00a0 language used\u00a0\u00a0 in court, it is a special language, from the word \u2018go\u2019 right till the end of the proceedings…\u00a0 Everything has a special word from \u2018If it please…\u2019 to \u2018Much obliged\u2019.<\/p>\n

Mr. Alex Chang taught me\u00a0 to think critically,\u00a0\u00a0 read, understand\u00a0 and scrutinise\u00a0 all\u00a0 evidence,\u00a0 pleadings, submissions and relevant case authorities in order to tender flawless oral\u00a0 and written submissions.\u00a0\u00a0 It dawned on me that when it comes to submission less is more.\u00a0\u00a0 Precision is the key.<\/p>\n

Mooting and litigation is heaven and earth.<\/p>\n

When I was reading another file on the\u00a0 assessment of damages file, a matter which started life in the High Court and ended in the Apex Court, I made another discovery, in Malaysia, we also have instructing solicitors and counsel will be instructed based on their\u00a0\u00a0 skills and experiences.<\/p>\n

Some seniors told me that they study law as they do not like Mathematics.\u00a0 I found out the hard truth, if\u00a0 you do not have a\u00a0 good mathematical sense\u00a0 to calculate costs, damages and compensation, you cannot\u00a0 handle commercial litigation.\u00a0\u00a0\u00a0 In that\u00a0 file,\u00a0\u00a0 I fascinated to see how Mr Chang reduced a RM74 million in damages to NOTHING…<\/p>\n

Advocacy was taught in the University,\u00a0 that was as good as watching the TV Series…<\/p>\n

Again I found out, in the movies, the beautiful speeches were\u00a0 scripted.\u00a0\u00a0 In practice we do not have such luxuries.\u00a0\u00a0 I\u00a0 was very impressed by the advocacy skills of the counsel in the extraction of\u00a0\u00a0 testimony that we need from the \u2018unwilling\u2019 witnesses.\u00a0 I\u00a0 felt butterflies\u00a0 in my stomach during\u00a0 the cross examination from the comfort of gallery.<\/p>\n

It\u00a0 was\u00a0 such\u00a0 a pleasure for me to be part of the members in Alex Chang & Co as\u00a0 I have learnt much during that time.\u00a0\u00a0 Mr\u00a0 Alex Chang Huey Wah\u00a0 and\u00a0 Miss Lim Soo Zee inculcated\u00a0 in\u00a0 me the qualities to be\u00a0 meticulous, hardworking and\u00a0 fast reacting.<\/p>\n

I would like to express my appreciation to my colleagues for their assistance and patience in helping me complete the tasks given.\u00a0 Last but not least, I would like to express my\u00a0 gratitude towards Mr Alex Chang for his care,\u00a0 advice, light moments with the other colleagues\u00a0\u00a0 and guidance; especially for\u00a0 forgiving my\u00a0\u00a0\u00a0 mistakes.\u00a0\u00a0\u00a0 It was\u00a0 really an\u00a0 eye-opening \u2018stint\u2019\u00a0 to undergo a mini-pupillage\/ internship\u00a0 at\u00a0 Alex Chang & Co.<\/p>\n
