The setting felt so solemn, everyone that walked pass me appeared so professional. The agenda of the day was to get directions from the learned judge, which usually happens in the courtroom, however, perhaps the goddess of luck, Tyche, was on my side that day, I was blessed with the opportunity to enter the chambers (The learned judge’s private office within the courthouse, but outside the public courtroom. It is used for administrative tasks, reviewing case files, and hosting informal or confidential hearings that are closed to the general public) when the directions were given.

Being merely an attachment student to a law firm who does not have any experience in this field, I thought to myself that perhaps this would be the only time I would ever visit the High Court before I finish my degree. I was delighted to be wrong in this. What quickly followed the case management day was trial, and before this big day were various researches and what seemed to be endless meetings. I was definitely nervous. Once again, I step foot into the courtroom. This time, instead of sitting in the gallery and only be able to listen to what was happening, Mr. Chang had asked permission from the learned judge for attachment student and pupil in chambers from both firms to be seated at the counsel table whereby fortunately leave was granted by the learned judge to rest my laptop and use my laptop to record the notes of proceedings. More importantly, even though it was just a simple task of noting down what was said during the trial, I was able to participate. Despite not getting 8 hours of sleep the night before, the fact that I was part of this trial, kept my brain awake the whole day.

The experience was both thrilling and stressful. Different people were talking back-to-back and I definitely struggled a bit at first to catch what was said and who it was said by, but eventually I managed to navigate my way through my task. This task definitely improved my skill of grasping crucial points from lengthy conversations as well as my typing speed, which I will admit, definitely still has room for improvement.

One of the most interesting aspects of the trial was when the examination in chief and cross examination took place. What I will definitely remember vividly from this experience is how the counsel worded their sentences when they posed questions to the witnesses. It was fairly fascinating for me as every time a question was being asked, it was asked in a way I never thought it could have been possible. The methods and techniques that were used when questions were posed to the witnesses were always out of my expectations and caught me off guard. It gave me new point of views which I find exciting and educational.

Cross examinations were definitely my favourite part of the whole trial. Questions were carefully crafted to challenge the other party’s witnesses’ credibility and to highlight the inconsistencies in the testimony. This process fully demonstrated the importance of precision and attention to detail of legal professionals to the documents presented to them as missing out even the slightest detail may affect the outcome of the case.

As the trial progressed, I noticed the extensive preparation required by lawyers. Preparation not only had to be done the day before trial, even between breaks, I found myself busy tidying up notes to be used and discussed in the breaks given afterwards. Life of a lawyer seemed to be way busier than anything I have ever imagined. It was not just the glamour and aura depicted in dramas like the Suits.

The counsel of parties presented their cases in a structured and organised manner, carefully referring to evidence, policy terms and relevant case laws. It became increasingly apparent to me that success in litigation not only depended on the counsel’s knowledge of the law and facts of the case, but also on the preparation and strategic presentation of evidence and supporting documents.

This experience was both educational and insightful as it not only gave me a glimpse of how a trial is actually conducted, but it also made realise how different real-life trials are, to what was described in textbooks taught in lectures and projected by TV dramas. The trial provided a valuable understanding of courtroom procedures, advocacy skills and the complexities involved in actual disputes. Life, more than often involves more than a clear distinction of black and white, where there are big patches of grey areas that are left to be decided. This is when legal professionals step in and present their arguments in favour of their clients to the honourable court for the learned judge to decide. This memorable experience definitely exposed me to a more realistic trial than whatever the media could have offered. Litigants’ hard work is also not to be undermined in a successful litigation as “Chance favors the prepared mind.” – Louis Pasteur.

Lim Mian Ying

Versi Bahasa 中文版 On the very first day of my attachment, which also happened to be the first day of my very first job, I was very fortunate to be given the opportunity of going to the honourable court. I remember stepping into the High Court of Kuala Lumpur with the thought in my […]

[43,107
